We explore how the worldwide economic downturn of the early 2000s affected imprisonment rates across Europe. We test three hypotheses: (i) the recession caused an increase in incarceration rates directly, regulating the excess in labour supply; (ii) it did it indirectly, by affecting crime; (iii) its effects varied according to the institutional context – countries’ welfare states and criminal justice traditions. We use cross-national panel data to fit fixed, random and mixed-effects models and to explain variations in incarceration rates within and across countries during 12 years. The results show that the economic crisis had multiple effects on imprisonment and that these were moderated by the institutional context, increasing it in countries with less comprehensive welfare states and more punitive penal traditions and decreasing it in countries with penal-welfarist policies.
La sobrerrepresentación de los jóvenes extranjeros en los centros de internamiento para menores infractores es un hecho constatado por la literatura criminológica. Se pueden esgrimir diferentes argumentos para explicar dicho fenómeno. El presente artículo tiene por objeto contrastar diferentes hipótesis explicativas de esta sobrerrepresentación. Dividiendo estas hipótesis en aquellas fundamentadas en el comportamiento delictivo de los menores extranjeros y las que ponen su foco en la actividad del sistema penal. Para testar estas hipótesis, se utilizan datos oficiales de detenciones policiales y condenas en España, así como datos secundarios obtenidos de investigaciones previas. El estudio y contraste de dichos datos permite afirmar que el comportamiento delictivo de los menores extranjeros es un elemento insuficiente para explicar su sobrerrepresentación en los centros de internamiento. Este hecho sugiere que la actividad selectiva del sistema penal sobre estos menores toma un papel relevante a la hora de entender las tasas de internamiento.
The distribution of police activity throughout society is a key issue for distributive justice and police legitimacy. This article presents two studies on the distribution of police identification checks in Catalonia (Spain) using data provided by Mossos d'Esquadra (the Catalan Regional Police). The first study explores the demographic distribution of ID checks, in other words, which groups of people are more likely to be stopped and have their identification checked by police. The second study examines the geographical distribution, that is, in which places are there greater concentrations of ID checks. The results show that with regards to demographics, men, young people and foreign people are associated with higher levels of ID checks. In addition, the geographical distribution is not primarily driven by crime rates, thus, in general, it seems that the distribution of ID checks is not as strongly related to crime as may be expected.
Este texto pertenece a una mesa redonda que ofrece un debate con James B. Jacobs, autor del clásico de la sociología de las prisiones Stateville: The penitentiary in mass society (1977), sobre la vigencia de su obra cuarenta años después. Este comentario tiene por objeto reflexionar en torno a las implicaciones de la educación en prisión a partir de la lectura de Stateville y del seminario que se impartió en la Universidad Pompeu Fabra para actualizar el debate sobre la monografía. En primer lugar, se expondrá el análisis de Jacobs acerca de la educación en prisión, subrayando la problemática de gestión que esta puede suponer. En segundo lugar, se apuntará la situación de la educación en las prisiones españolas. Para ello se señalarán los puntos en común con Stateville, se demostrarán los posibles beneficios que comporta la educación para los internos y, finalmente, se advertirá de las particularidades y precauciones que se deben considerar para poder garantizar el derecho a la educación a la población reclusa.
Los estudios realizados desde una perspectiva de género en otros países y la normativa internacional subrayan la importancia de (re)conocer las similitudes y diferencias existentes entre mujeres y hombres penados y su impacto en la ejecución de las penas. En España, a pesar de disponer de numerosas investigaciones que analizan el género en prisión, carecemos de estudios que hagan lo mismo en el sistema de medidas penales alternativas. El presente trabajo pretende conocer si existen diferencias entre las mujeres y los hombres penados a medidas penales alternativas. Para ello, se lleva a cabo un análisis bivariado que estudia la relación del sexo con variables sociodemográficas, personales, procesal-penales correspondientes a las medidas penales alternativas impuestas sobre una muestra representativa de 580 mujeres y hombres que finalizaron una medida alternativa. Los resultados señalan que existen diferencias por sexo significativas entre las diferentes variables analizadas.
