Este trabalho pretende compreender a figura da legitimação fundiária, introduzida no Brasil pela Medida Provisória nº 759 de 2016 e pela lei federal nº 13.465 de 2017, através do conceito de acumulação por espoliação, formulado por David Harvey. A discussão sobre a acumulação por espoliação demonstra os limites da teoria da forma jurídica em Pachukanis. Posta nos seus devidos termos, a teoria marxista do Direito deve, com apoio no conceito de ideologia em Lukács, organizar com rigor teórico as práticas do direito insurgente, inclusive com relação ao tema da questão fundiária.
Este trabalho propõe uma aproximação crítica entre o conceito de ideologia constitucionalmente adotada, próprio do direito econômico, e as interpretações da sociologia do direito, especialmente o conceito de constituição simbólica, por meio de uma pesquisa bibliográfica transdisciplinar. A pretensão articulada é de expor insuficiências da primeira noção, a partir da convergência de problemáticas entre os dois campos teóricos mencionados. A constitucionalização simbólica revelaria a expressão sociológica do esforço de concordância entre direito e economia que o direito econômico busca na noção de ideologia constitucionalmente adotada, concordância que se vê esgarçada quanto maior for o efeito simbólico-ideológico do texto constitucional. Esta circunstância estaria ampliada a partir da experiência constitucional desde 1988, na qual a pluralidade de eixos axiológicos da constituição econômica teria maximizado os compromissos dilatórios do texto constitucional positivado. Com relação à noção de pluralismo produtivo, outras questões surgem. De um lado, a dificuldade estrutural em promover as mudanças sociais necessárias no nível da organização societária. De outro, estes mesmos obstáculos estruturais indicam a inviabilidade da hegemonia neoliberal para o sucesso axiológico normativo da Constituição.
