A questão ambiental no Brasil tem se intensificado nas últimas décadas, após o momento de crescimento urbano na década de 60. As expressões "desenvolvimento sustentável", "sustentabilidade" e "gestão ambiental" surgiram por meio de estudos realizados pela Organização das Nações Unidas acerca das mudanças climáticas, como uma resposta para a crise social e ambiental na segunda metade do século XX. A busca por alternativas sustentáveis que melhorem a qualidade de vida da população tem permeado as ações de diversas empresas, em especial os shoppings centers. Deste modo, o presente artigo realiza um estudo de caso acerca do sistema de gestão ambiental (SGA) adotado pelo shopping RioMar, localizado na cidade de Fortaleza/CE. A coleta de dados foi realizada por meio de pesquisa documental e bibliográfica. As práticas sustentáveis vão desde a construção do referido shopping, tendo o mesmo recebido inclusive a Certificação Aqua, além do consumo de água até 70% menor nos banheiros, devido ao uso de sistema de descarga a vácuo, torneiras com sensor e arejadores, chuveiros com fechamento automático e mictórios economizadores. Este estudo contribui para o avanço das pesquisas da área, especificamente no setor de shoppings centers.
Desde a promulgação da Lei Maria da Penha ocorreram discussões no seio social acerca das iniciativas promovidas pelo Estado Brasileiro no enfrentamento da violência perpetrada contra mulheres em nosso país. De modo a garantir os direitos e garantias elencados pela Lei Maria da Penha, é indispensável à articulação entre os Poderes Executivo, Legislativo e Judiciário, para o atendimento da demanda de casos de violência doméstica e familiar contra a mulher, além da formação de profissionais para atuação nesses casos, especialmente para que sejam asseguradas as inovações legislativas. Desse modo, ressalta-se a importância do Poder Judiciário e de suas funções no processo de formulação e implementação de políticas públicas voltadas às mulheres em situação de violência doméstica e familiar, além da aplicação das medidas protetivas e de urgência à vítima, o desenvolvimento de programas para a conscientização e, consequente, ressocialização do agressor, garantindo, dessa forma, a efetividade da Lei Maria da Penha.
A regularização de terras indígenas sempre foi um tema de grande relevância e envolto de notórias polêmicas. O processo regulatório dessa categoria de terras envolve em sua imensa maioria de casos, conflitos entre os povos indígenas ocupantes daquelas terras e terceiros interessados, seja também pela ocupação de boa-fé seja pelo interesse financeiro que essas terras possuem. A questão, não raras vezes, chega às portas do Poder Judiciário, ao qual se atribui a responsabilidade de determinar quem realmente possui o direito real sobre aquelas propriedades. No entanto, quando esses casos atingem a instância máxima do Judiciário, é possível observar que raramente se realiza o diálogo das fontes. O presente trabalho se propõe a analisar se o Poder Judiciário brasileiro se preocupa em realizar tão somente o controle de constitucionalidade, mas também o controle de convencionalidade, observando a maneira como julga a CIDH quando se trata de casos que envolvam terras indígenas. O estudo se justifica pela relevância do tema para esses povos quanto aos direitos humanos firmados pela Convenção Americana, utilizando-se para tanto de uma pesquisa bibliográfica, descritiva e documental através do método exploratório e dedutivo.
