Este artigo objetiva analisar o funcionamento do conceito discriminação positiva, à luz da Semântica Argumentativa (cf. DUCROT; CAREL, 2005; DUCROT, 1988), em enunciados relacionados à proibição de diferença salarial e critérios de admissão, para trabalhadores com e sem deficiência, presentes na Constituição de 1988. Postula-se que tal conceito a priori envolve palavras que participam de blocos semânticos distintos, discriminação, com o aspecto DISCRIMINAÇÃO PT NEGATIVA, em oposição a igualdade, IGUALDADE PT POSITIVA. Entretanto, os dados apontam que tal oposição semântica assumiu nos enunciados constitucionais uma apresentação sui generis de DISCRIMINAÇÃO NE IGUALDADE, evidenciando que, juridicamente, para se igualarem possibilidades é por vezes preciso discriminar, ainda que positivamente.PALAVRAS-CHAVE: Semântica. ABSTRACTThis paper analyses the function of the concept of positive discrimination, in the light of the Argumentative Semantics (cf. DUCROT; CAREL, 2005; DUCROT, 1988), in statements related to the prohibition of wage differences and acceptance criteria, to workers with and without disabilities, present in the Brazilian Constitution of 1988. This concept necessarily involves words that participate in distinct semantic blocks, discrimination, with the aspect DISCRIMINAÇÃO PT NEGATIVA (i.e., DISCRIMINATION THEREFORE NEGATIVE), as opposed to equality, IGUALDADE PT POSITIVA (i.e., EQUALITY therefore POSITIVE). However, the data indicate that such semantic opposition assumed in these statements those a unique presentation of DISCRIMINAÇÃO NE IGUALDADE (DISCRIMINATION however EQUALITY), highlighting that, legally, to equalize possibilities is sometimes necessary to discriminate, even if positively.KEYWORDS: Semantics.
