Background: Achieving sustainable economic and social growth through advances in health is crucial in Latin America within the framework of the United Nations Millennium Development Goals.
I. el outsourcing: definición y juStificación del teMaEl término outsourcing no es un concepto que emerge del campo del derecho. Tiene su origen en otras disciplinas, tales como la administración y la economía. 1 De manera muy general, postulamos que existe outsourcing cuando una empresa recurre a otra para que ésta última realice ciertas actividades que se relacionan con los servicios prestados por la primera. Tales actividades pueden: (i) consistir en la producción de un bien o en la realización de un servicio, (ii) estar relacionadas con la actividad principal desarrollada por la primera empresa, o bien, referirse a aspectos necesarios o accesorios de su producción u operación, y (iii) darse de manera temporal o permanente.Nótese que la literatura ha usado diferentes términos para referirse al outsourcing, en particular, debido a que se trata de una palabra que proviene del idioma inglés. Algunos de los términos usados por la literatura para referirse al outsourcing son el de externalización 2 y el de subcontratación. 3 A lo largo del presente escrito, utilizaremos la palabra outsourcing entendida de la forma referida en el párrafo anterior.
