The main objective of this work was to determine the right to food of children and adolescents as part of their best interest in the Ecuadorian legal system. The present research is descriptive, of documentary type, based on the bibliographic review by means of the analytical method. The Ecuadorian legal system recognizes children and adolescents as subjects of priority and preferential attention, and provides within its regulations the validity and application of their best interests. This best interest of children and adolescents is a progressive advance in the prevalence of their rights and guarantees. The right to food is part of this best interest, since it refers to the satisfaction of their most basic needs, indispensable to protect their life, health, welfare, survival, development and dignified life. The right to food is an integral aspect essential for the good life of the child and adolescent, covering needs from healthy and nutritious food, education, housing, recreation and sports, among others. Parents are the main holders of the food obligation of their children or adolescents, even in cases of limitation, suspension or deprivation of parental authority.
The research aims to determine the constitutional and legal provisions that regulate the legal figure of adoption in the Republic of Ecuador, with special attention to the existing normative contradictions between them. The research is of a descriptive documentary type, with a focus on analytical and hermeneutic methods. The Constitution recognizes the figure of adoption in its article 68. The Ecuadorian legal system does not handle full adoption as stipulated in article 152 of the Childhood and Adolescence Code. In view of the fact that in the Civil Code there is a notable conservation of the kinship ties of the adoptee with his family of origin and the exceptions that segregate the adopted children in matters of inheritance with the adopter’s family. It is concluded that it is necessary that the National Assembly, at the moment of issuing or reforming a new law for the protection of minors, carry out an exhaustive normative analysis so that this new codification is related and complementary to the laws that are in force, this with the objective that there are no legal anomalies between two norms and that an effective application and enjoyment of the rights of the minors can be given.
La Constitución Ecuatoriana prevé que la soberanía reside en el pueblo, su voluntad es el fundamento de la autoridad, ejercida a través de los órganos del poder público y demás formas de participación directa. Para ello, se reconoce el derecho de participación, manifestado por medio de diversos mecanismos regulados constitucionalmente. Este estudio pretende analizar los principales preceptos constitucionales y legales que sustentan el derecho electoral en el Ecuador. La investigación reviste carácter descriptivo, de tipo documental, fundada en el método analítico. El derecho electoral ecuatoriano puede definirse como el conjunto de normas y organismos que regulan y ejecutan la estructura necesaria para la prevalencia del sistema democrático, mediante la garantía de los medios o mecanismos de participación en condiciones de libertad y paridad, soportado en los principios de diversidad, pluralismo ideológico, e igualdad. Se concluye que la función electoral alude a la regulación del sistema electoral ecuatoriano y comprende: procesos electorales, financiamiento electoral, autoridad electoral, justicia electoral y partidos políticos, expresión del voto y la transformación de esos votos en un puesto de elección popular. Esta función se sostiene en los derechos de participación de las personas, en principios, en organismos, para velar por la inclusión de pensamientos e ideologías.
La presente investigación pretende reflexionar sobre el régimen notarial en el Ecuador. Para alcanzar dicho objetivo, el manuscrito está basado en el método analítico siendo una investigación de alcance descriptivo y de tipo documental. Las fuentes principales son la Constitución del Ecuador y un conjunto de doctrina y jurisprudencia acerca del tema seleccionado. Los resultados obtenidos dan cuenta de la importancia que reviste tener certeza en los documentos y declaraciones realizadas, lo cual se obtiene a través de la atribución nacida del imperio estatal y la soberanía correspondiente; en este sentido, el Ecuador como Estado garante de los derechos de las personas acude al otorgamiento de competencias para dar fe pública, concretamente, la tarea les está encomendada a los notarios. De las conclusiones se puede destacar, que en el Ecuador las notarías poseen una descentralización parcial porque tienen trabajadores a su cargo, pero cada una de sus actividades está ceñida a las órdenes y disposiciones emanadas del Consejo de la Judicatura y del ordenamiento jurídico en general.
