Resumen: La finalidad de este documento es analizar, a partir de criterios tecnológicos, estándares regulatorios y recomendaciones internacionales, el impacto de la tecnología blockchain en los mercados de crédito y cómo dicha dinámica podría tener efectos directos en los mercados latinoamericanos, a saber, producir mayor eficiencia e inclusión financiera en la región. Para tal fin, se contextualizará el alcance de la tecnología blockchain, se desarrollarán las posibles aplicaciones de dicha tecnología en los mercados financieros y, por último, se analizarán las propuestas regulatorias sobre la aplicación de dicha tecnología en los mercados de crédito latinoamericanos en lo relacionado con la administración de riesgos e inclusión financiera. I. introduCCiónLa integración de los mercados financieros a nivel global, regional y bilateral ha tenido un acelerado desarrollo durante las últimas décadas, debido a la negociación de servicios y productos financieros transnacionales, las innovaciones tecnológicas y a la presencia de conglomerados financieros en todas las latitudes del globo. Ahora bien, el proceso de integración se ha desarrollado a través de normas de derecho internacional público como es el caso del Acuerdo General sobre el Comercio de Servicios y los dos protocolos adicionales en materia de servicios financieros dentro del marco de la Organización Mundial del Comercio, con el fin de buscar una integración gradual, sectorial y con excepciones. En igual sentido, en el marco de integración regional se han realizado esfuerzos de integración en los mercados financieros, como es el caso de la Comunidad Andina, en donde a pesar de existir una serie de normas comunitarias sobre comercio de servicios (decisiones 439 de 1998 y 510 de 2001) no se han desarrollado adelantos de fondo sobre comercio de servicios financieros. De igual manera, el Mercado Común del Sur (Mercosur) cuenta con un Acuerdo Marco de Servicios suscrito en 1997, dentro del cual se encuentra un anexo en materia de liberalización de servicios y productos financieros. El objetivo de este trabajo es realizar un análisis histórico de la evolución de la actividad bancaria desde la época mesopotámica hasta los esquemas digitales actuales, haciendo hincapié en la institución de la responsabilidad civil por la actividad bancaria. El presente texto pretende, en primer lugar, identificar los diferentes ámbitos de la responsabilidad civil bancaria, por lo que se aborda su origen y desarrollo. En segundo lugar, estudiar el impacto de la culpa en el régimen de responsabilidad por la actividad financiera. Posteriormente, se realiza algunas consideraciones relacionadas con los últimos avances legales y jurisprudenciales sobre un régimen objetivo de responsabilidad civil bancaria. La metodología de investigación consistió en el análisis de fuentes bibliográficas e información pública. Es de tipo descriptivo y enfoque cualitativo; tiene el propósito de explicar las características del tema tratado a partir del análisis de las fuentes de información.
