La Constitución federal mexicana, a partir de la reforma del artículo 17 del 18 de junio de 2008, introduce al orden jurídico nacional los mecanismos alternativos de resolución de conflictos como un derecho humano. Es así como la justicia alternativa alcanza su punto más alto, en virtud de que la norma constitucional la establece como obligatoria para todas las áreas del derecho. Siguiendo la directriz que señala la Constitución en la materia, el presente artículo a través un análisis crítico de la nueva Ley de Justicia Alternativa del Estado de Chihuahua, como caso de estudio, busca determinar si la normativa estatal garantiza un verdadero acceso a la justicia mediante los mecanismos alternativos de resolución de conflictos.
Este trabajo se enfoca en las organizaciones de la sociedad civil ubicadas en Ciudad Juárez, México. El instrumento idóneo para la recolección de datos fue la creación de una batería de preguntas para realizar entrevistas en profundidad, aplicadas a directores y dirigentes de las dichas organizaciones. Se analizó la percepción e incidencia que los participantes manifestaron, visualizando los resultados con el apoyo del programa MAXQDA a través de nubes de información y tablas desglosando el contenido, obteniendo una imagen clara de las percepciones e incidencia y participación que las organizaciones de la sociedad civil han logrado.
