O objetivo do presente artigo é demonstrar como as teorias de Ronald Dworkin e Klaus Günther são complementares e oferecem uma boa fundamentação para as decisões judiciais na resolução de casos difíceis. “Boa” no sentido da sua coerência e integridade, o que, por sua vez, resignifica a própria atuação do Poder Judiciário, sobretudo da jurisdição constitucional. Ambos autores argumentam que a aplicação do direito não se restringe à subsunção de um fato concreto a uma norma geral e abstrata. O papel do juiz é também o de construir e reconstruir o direito, por meio da sua aplicação com base em princípios. Neste sentido, ambos autores diferenciam a decisão judicial da decisão legislativa (aplicação e legislação), bem como, o tipo de argumento que as fundamentam.
