La investigación tiene como objetivo realizar un análisis jurídico sobre la conciliación como medio alternativo de solución de conflictos en el procedimiento directo normado en el Código Orgánico Integral Penal (COIP, 2014), y otros instrumentos legales. La Constitución Ecuatoriana de 2008, reconoce al arbitraje y la mediación como mecanismos para la solución de controversias. La metodología se trabajó desde un enfoque cuantitativo, de tipo descriptiva de campo no experimental, se aplicó una encuesta a 30 profesionales del derecho. Se evidenció que en la práctica se violentan ciertos principios del debido proceso, como son el de derecho de defensa, igualdad procesal, y legalidad. Se sugiere que la conciliación en el procedimiento directo, en la realidad legislativa penal ecuatoriano, debe ser revisada y enrumbada al respeto del debido proceso, que garantice el cumplimiento de lo normado, no solo en la Constitución del 2008, sino en lo establecido por Instrumentos internacionales y locales.
