Este trabajo pretende analizar cómo se gesta la visión de paz en el Estado constitucional colombiano, desde la perspectiva de la corte constitucional, como máximo órgano de cierre, el cual se arroga la función interpretativa de los derechos fundamentales, valorando los principios constitucionales que subyacen en la carta magna. En este sentido, el derecho a la paz ha sido enriquecido desde lo axiológico e interpretativo, lo cual permite la concreción de derechos y las condiciones jurídicas pertinentes para solucionar el conflicto por medios no violentos, como corolario ha sido esta corporación la encargada de revisar y ejercer control de los decretos, leyes y actos legislativos en relación al proceso de paz. No se puede desconocer que la sociedad colombiana ha estado expuesta a estructuras violentas, por tanto, las condiciones de la negociación pueden generar una percepción de desconfianza e impunidad, para ello, es necesario iniciar procesos de socialización de medios alternos de solución de conflictos, a través del ejercicio sistemático del diálogo, el consenso y la cooperación; con el fin de que estos permeen en la cultura y rompan los paradigmas de violencia. Esta investigación es de tipo descriptivo con un enfoque cualitativo, se recurre a estudios que contextualizan el concepto de paz como un derecho humano, seguidamente se acude a las decisiones de la corte constitucional desde su función argumentativa y reflexiva; Como corolario, se identifican los aspectos de mayor significancia en un Estado que se encuentra forjando un camino político, jurídico y social de transición hacia la paz.
