Entre 1804 e 1817, a capitania de Pernambuco foi administrada pelo governador Caetano Pinto de Miranda Montenegro. Como bacharel em leis e doutor pela Universidade de Coimbra, Caetano Montenegro foi um dos poucos letrados a assumir a administração de capitanias na América portuguesa. A maior parte de seu governo ocorreu durante a estadia da corte portuguesa no Rio de Janeiro, a partir de 1808. Aliando-se a política desenvolvida pela corte joanina, que ampliou vilas, comarcas e instituiu juízes de fora em diversas localidades, o governador atuou para aumentar o número de circunscrições na capitania de Pernambuco. A expansão da esfera jurídica e administrativa atendia tanto aos interesses da corte do regente, quanto das elites das capitanias. Como buscaremos mostrar, sua formação jurídica teve significativo impacto na forma como conduziu sua administração. Como magistrado, além de governar a capitania de Pernambuco, entendia-se como um indivíduo imbuído de jurisdição, com o poder de dizer o direito. Tal entendimento e concepção política estiveram presentes nas solicitações que apresentou ao regente, ao tratar da necessidade de melhorar a prática da justiça na localidade.
Resumo:A criminalidade foi um problema que sempre preocupou as autoridades da Província de Pernambuco, principalmente quando concentrada na cidade do Recife, sua capital e espelho das elites políticas e econômicas provinciais. Em vista disso, e com base em algumas ocorrências sobre crimes, perturbações da ordem e relatos de jornais, nosso objetivo é tecer algumas análises sobre a criminalidade no Recife do século XIX, suas formas de denúncia, e as relações com os sujeitos envolvidos. Palavras-Chave: Recife, criminalidade, ocorrências policiais.Abstract: Crime has always been a problem that worried the authorities of the province of Pernambuco, especially when concentrated in the city of Recife, its capital and the mirror of provincial political and economic elites. In view of this, and based on some occurrences on crimes, disorder of the order and reports of newspapers, our objective is to make some analyzes on the criminality in Recife of century XIX, its forms of denunciation, and the relations with the subjects involved.Segundo Émile Durkheim não há sociedades sem crime, para o autor o crime é um fato social integrante das sociedades pautadas em códigos legais, e passível de punição. Ele afirma que não há qualquer indício de que as taxas de criminalidade tendam a baixar durante a passagem de uma sociedade com formas de organização mais simples para as 52 mais complexas. 1 Ainda alega que é simplesmente normal "que exista uma criminalidade, contanto que atinja e não ultrapasse, para cada tipo social, um certo nível que talvez não seja impossível fixar de acordo com as regras precedentes" (DURKHEIM, 2011, p. 83). Ou seja, o crime é um ato que faz parte da sociedade, mas pode chegar a níveis alarmantes para um determinado espaço ou segmentos da sociedade, ultrapassando a normalidade do fato social, mas reitera que "o crime é normal porque uma sociedade isenta dele é completamente impossível" (DURKHEIM, 2011, p. 87). Em seu livro, o sociólogo francês ainda afirma que "o crime deve deixar de ser concebido como um mal que nunca é demais limitar; antes, longe de vermos motivos para nos felicitarmos quando desce demasiado em relação ao nível habitual, podemos estar certos de que esse processo aparente é ao mesmo tempo contemporâneo e solidário de alguma perturbação social" (DURKHEIM, 2011, p. 83). Chegou-se a afirmar que Durkheim estaria fazendo uma apologia do crime (ALBUQUERQUE, 2009), pois infere que a baixa de crimes em níveis muito inferiores, representa na verdade uma perturbação, um novo problema que precisa de atenção da sociedade. Ao analisar o cotidiano da cidade do Recife no século XIX, temos um exemplo do quanto o crime era perceptível e integrante naquela sociedade, tanto pelos grupos sociais que viviam e transitavam pela cidade, geralmente pessoas que tinham algum tipo de relacionamento socioeconômico, cultural ou simbólico com o espaço urbano.
