Résumé Dans un ouvrage récent, David Leopold s’inscrit en faux contre la thèse, reçue désormais à titre d’évidence, d’une opposition radicale entre la pensée de Marx et les revendications des droits de l’homme. Cette réévaluation stimulante ne suffit pas à dissiper la critique adressée par le jeune Marx aux droits de l’homme critique que ses écrits de maturité radicalisent. On peut cependant, sans prétendre déceler chez l’auteur du Capital une appréciation positive du droit, soutenir que sa pensée souffre sur ce point d’une faiblesse logique. On voit mal, en effet, comment l’émancipation individuelle la visée du communisme selon Marx peut se passer d’une revendication de droit. C’est pourquoi il n’est pas impossible de réinscrire l’intention émancipatrice de Marx, en dépit de Marx lui-même, dans la tradition des droits de l’homme.
