Les formes de la délibération interprofessionnelle : le sens du dialogue Lorsqu'on s'intéresse à la délibération politique sur et dans la protection sociale, on est confronté à un vocabulaire à la fois très présent, très valorisé, mais dont les définitions semblent particulièrement flexibles. Ainsi, aucun débat et décision touchant à la protection sociale, à l'emploi, à la formation professionnelle ou au travail ne se passe aujourd'hui du « dialogue social » avec ou entre les « partenaires sociaux ». Cette méthode de délibération politique, qui en appelle aux organisations patronales et syndicales pour indiquer les voies de réforme des politiques sociales et d'emploi au sens large, s'est peu à peu imposée à partir de la fin des années 1950 jusqu'à aujourd'hui (Freyssinet, 2010). Le terme « dialogue social » lui-même apparaît pour la première fois en 2004 dans le Droit avec la « loi relative à la formation professionnelle tout au long de la vie et au dialogue social ». Il faudra toutefois attendre la loi du 31 janvier 2007 dite de « modernisation du dialogue social » pour que le terme soit défini dans son contenu comme « procédures de concertation, de consultation et d'information ». Cette même loi consacre véritablement le dialogue social comme méthode de délibération politique sur les rapports collectifs de travail en prévoyant que toute initiative gouvernementale « en matière de relations collectives ou individuelles de travail, d'emploi et de formation professionnelle » soit précédée d'une négociation nationale interprofessionnelle. En cas d'accord entre partenaires sociaux, celui-ci doit fournir la base de la nouvelle législation, sans que le gouvernement et le Parlement ne soient d'ailleurs tenus d'en respecter les termes.
