Le tribunal du preteur: contraintes symboliques et politiques sous la Republique et le debut de l'EmpireA Rome, sous la Republique et pendant tres longtemps encore sous l'Empire, la preture fat la magistrature qui avait le plus d'importance pour la vie quotidienne des citoyens. C'etait d'elle en effet que dependait l'essentiel de la vie judiciaire. Le preteur enon9ait le droit, ouvrait et sanctionnait les procedures. Le role qu'il jouait le mettait au cceur de la vie sociale et civique romaine. II etait, sans doute avec les tribuns de la plebe, celui dont les citoyens attendaient le plus, ou redoutaient d'avoir affaire, dans l'exercice quotidien de leurs activites. 1 Ceci avait au moins deux consequences. La premiere tenait a ce que le preteur attirait la foule des justiciables qui se pressaient devant son tribunal. On y faisait la queue en attendant son tour. 2 L'atmosphere, en cet endroit, devait etre fortement chargee d'attente et quelquefois d'angoisse. D'autant qu'avec le temps, le nombre des justiciables augmentait puisque celui des citoyens s'accroissait et que le nombre des affaires suivait revolution d'une ville qui devenait l'une des principales metropoles du monde mediterraneen. Au seul preteur urbain qui jusque lä avait suffi aux besoins d'une communaute de citoyens encore peu nombreux, on ajouta vers 242 le preteur peregrin qui eut la charge des relations avec les etrangers.
