U ovom radu daje se prikaz provedenog anketnog istraživanja kojeje za cilj imalo dobiti uvid u doživljaj i iskustva žrtava nasilja u obiteljismještenih u tri najveća skloništa za žrtve obiteljskog nasilja u Republici Hrvatskoj, i to od trenutka prijave nasilja do postupka na sudu (uključujući i njihovo iskustvo smještaja u skloništu). Novost koju donosiistraživanje jest uzorak koji je zatečen u skloništima za žrtve obiteljskognasilja, gdje je teško ostvariti otvorenost za anketiranje zbog potrebeinzistiranja na tajnosti lokacije skloništa. Slijedom te činjenice kontaktiskloništa s okolinom usmjereni su samo na službene osobe nadležnihtijela u cilju ostvarenja prava djece i odraslih žrtava na smještaju. Nedostaci istraživanja ogledaju se u činjenici da se radi o malom uzorku iudjelu neodgovorenih pitanja, što remeti stabilnost dobivenih rezultata.U uvodnom dijelu rada navedena je svrha rada te je prikazan značajefektivnog ostvarenja aktivne uloge žrtve u kaznenom i prekršajnompostupku, kao i djelotvornosti kontakta žrtve s drugim dionicima kojipostupaju u slučajevima nasilja u obitelji. Taj značaj nije samo rezultat implementacije Direktive 2012/29/EU u hrvatsko zakonodavstvo iproklamacija iz Protokola o postupanju u slučajevima nasilja u obiteljinego je u tom smjeru i odgovor judikature Europskog suda za ljudskaprava. Potom rad iznosi rezultate pilotnog istraživanja kojima žrtveiskazuju što misle o pristupu dionika iz Protokola o postupanju u slučajevima nasilja u obitelji prema njima kao žrtvama te o kvaliteti ikorisnosti dobivenih informacija i pomoći iz navedenih institucija.Cilj istraživanja razrađen je kroz tri istraživačka pitanja:1. Kako žrtve procjenjuju jesu li dobile cjelovitu informaciju o svojim pravima unutar sustava pravosuđa i policije?2. Kako žrtve procjenjuju jesu li pravovremeno obaviještene o ukidanju istražnog zatvora ili ukidanju mjera opreza i o drugim informacijama bitnim za sigurnost žrtve, koje joj trebaju pružiti policija idržavno odvjetništvo?3. Koji su prijedlozi za djelotvorniju i bržu pomoć od sustava iz pozicije žrtve obiteljskog nasilja?Za provedeno anketno istraživanje korištene su statističke metodeza obradu podataka, i to: deskriptivna statistika i kategorijske varijable, koje su prikazane kao frekvencija dobivenih odgovora i postotakodgovora za svaku pojedinu česticu. Opisni su odgovori postupkomkodiranja prevedeni u kategorije te je primijenjena analiza sadržaja.Ukupno gledano, rezultati su u skladu s provedenim istraživanjimadrugih autora, koji su također bili orijentirani na iskustva s različitimdionicima u sustavu iz perspektive žrtve obiteljskog nasilja. Rezultatijoš jednom potvrđuju da normativna prepoznatljivost nije garancijaadekvatne provedbe u praksi.
Rad obrađuje najčešće prisutan posebni uvjet za određivanje istražnog zatvora – opasnost od ponavljanja djela. To čini kroz prikaz standarda koje je postavila judikatura Europskog suda za ljudska prava u Strasbourgu u tumačenju Europske konvencije za zaštitu ljudskih prava i temeljnih sloboda te kroz primjenu Zakona o kaznenom postupku, sve popraćeno relevantnom sudskom praksom i statističkim pokazateljima o učestalosti primjene mjere istražnog zatvora. U radu se mogu pronaći odgovori na pitanja prati li pravo u Republici Hrvatskoj u zakonodavnom smislu i kroz sudsku praksu konvencijske standarde instituta istražnog zatvora, odnosno, ako ima odstupanja, u čemu se očituju te koji su trendovi i opasnosti.
