The Convention on the Elimination of All Forms of Discrimination against Women (CEDAW), which was adopted by the UN and by most countries of the world, has influenced women's rights and led to important developments in countries party to the treaty. Most Islamic countries have put reservations on some articles of the Convention citing Islamic law practices and local culture while ratifying the Treaty, but then have removed some of these reservations by passing adaptive laws. While some of these regulations such as women's share in inheritance, their testimony, and obedience to husband have a strong connection to main religious sources, others such as reduced sentences in honor killings, women carrying their own surname, voting in elections, and female genital mutilation are based on customary and tacit law judgments. Through CEDAW, Muslim countries have faced pressure and criticism in international platforms with the allegation that their laws on person, family, inheritance, punishments, citizenship, and procedural law involve discrimination against women. With the influence of the international atmosphere, women's movements have risen in Muslim countries and through legal changes there has been developments with regard to women's rights in line with CEDAW. Even though after CEDAW there is some convergence between the Islamic World and the West in terms of women's rights and gender equality, differences based on culture continue to exist.

Nâfile namazlar arasında ismi geçen tesbih namazı hakkında fıkıh literatüründe derin ihtilaflar bulunmaktadır. İhtilafların temel kaynağı tesbih namazı hakkındaki rivayetlerdir. Belli kişileri hedef alan rivayetlerde çok büyük mükâfat vaadiyle tarif edilen tesbih namazı, içinde her rekâtta önce on beş sonra onlu bloklar halinde yetmiş beş ve dört rekâtta toplam üç yüz tesbih cümlesi söylenen bir namazdır. Bu namazı Hz. Peygamber ve ashabından herhangi birinin kıldığına dair bir rivayet nakledilmemiştir. Rivayet kaynaklarında yer alan haberlere rağmen tesbih namazı ilk dönem fıkıh eserlerinde neredeyse hiç yer almazken sonraki eserlerin de birçoğunda zikredilmemiştir. Rivayetler hakkında hadis ve fıkıh eserlerinde yapılan değerlendirmelerde; tesbih namazı kılmanın çok faziletli olduğu, kılınmasında bir beis olmadığı ve kılınmasının bidat olduğu şeklinde başlıca üç eğilim tebarüz etmiştir. Tarihi süreçte özellikle iki uçta yer alan görüş sahipleri arasında karşılıklı olarak deliller kendi görüşlerini tahkim edecek şekilde değerlendirilmiştir. Günümüzde bazı dini çevrelerde tesbih namazını cemaatle kılmak için davet ve teşvikler yapılırken diğer bazılarında tesbih namazı bidat olarak telakki edilmektedir. Bu araştırmada tesbih namazı hakkında rivayet kaynaklarından başlayarak günümüze kadar yapılan değerlendirmeler eleştirel bir yaklaşımla gözden geçirilmiş ve yeni bir değerlendirme yapılmaya çalışılmıştır. Yapılan değerlendirmeler sonucunda Hz. Peygamber’in Müslümanların geneline tavsiye ettiği nâfileler arasında tesbih namazının bulunmadığı, bu sebeple bireysel olarak tesbih namazı kılmada bir sorun görülmese de faziletini abartarak insanları tesbih namazı cemaatine davet etmenin ve cemaatle tesbih namazı kıldırmanın doğru olmadığı kanaatine ulaşılmıştır.
