O presente artigo objetiva demonstrar a necessidade do Direito Internacional Privado em abranger a temática dos Direitos Humanos, especificamente através da análise acerca da Convenção de Viena sobre Contratos de Compra e Venda Internacionais - CISG. Portanto, foi utilizada uma abordagem qualitativa de obras bibliográficas, bem como o método dialógico-dedutivo, buscando correlacionar as categorias do direito internacional privado e dos direitos humanos, abordando os Princípios Orientadores da ONU sobre Empresas e Direitos Humanos como ponto de partida, exemplificando-se através do desabamento do complexo fabril Rana Plaza as consequências de violações de direitos inerentes à condição humana. Em síntese, conclui-se que a CISG é um instrumento possível de ser invocado para proteção desses direitos, por meio de seus artigos 7(2) e 35; além de também ser necessária e fundamental a atuação de internacionalistas na área, como advogados, para reforçar cláusulas em contratos que visem à proteção dos direitos humanos.
RESUMO:O presente artigo objetiva analisar a Colonialidade enquanto elemento constitutivo das organizações capitalistas, operando na apropriação que a sociedade patriarcal faz sobre o corpo da mulher em analogia à apropriação da natureza. A pesquisa foi realizada com a técnica descritivo-analítica, aliada a abordagem qualitativa, por meio de análise documental e legislativa, no intuito de correlacionar as categorias de colonialidade, propriedade privada e gênero; almejando compreender a forma como a mulher era inviabilizada dentro do ordenamento jurídico brasileiro, bem como buscar no Novo Constitucionalismo Latino-Americano e na teoria do Ecofeminismo novas perspectivas de combate a essa problemática.
