Uma das principais causas é a sua indicação como tática de medicina defensiva por parte do obstetra, buscando evitar uma ação judicial por erro médico ou negligência, assim, a cesárea se apresenta para muitos obstetras como uma opção de parto em que ambos, mãe e recém-nascido, estarão mais protegidos de possíveis complicações. A partir da análise de diferentes trabalhos publicados posteriormente foi possível constatar que as condutas médicas têm sofrido uma grande influência do aumento da judicialização da medicina. A Ginecologia e Obstetrícia é uma das especialidades mais afetadas, dessa forma, especialistas de diversos países recorrem à cesariana como uma forma de evitar um possível processo por erro médico ou negligência. É necessária uma avaliação mais aprofundada dessa situação, bem como o desenvolvimento de medidas que busquem sanar esse problema e garantir o melhor contexto de saúde possível tanto para a gestante quanto para o recém-nascido.
