Пандемія COVID-19 несподівано змінила світопорядок: від глобального та масштабного обмеження (сегментування) прав і свобод людини до посилення дискримінації, сегрегації, нетерпимості і цензури думок та висловлювань, вакцинного націоналізму. Загальмувавши міграцію та призупинивши свободу пересування осіб, відбулося “зіткнення” захисту універсальних прав людини і національної безпеки, етики, моралі та консюмеризму. Конституційні та світоглядні цінності, народовладдя (демократія), правовладдя (верховенство права) потребують суттєвого переосмислення під впливом поширення COVID-19 у Європі та світі. Вакцинний націоналізм проявляється не лише у масштабному резервуванні вакцини урядом конкретної держави для власних потреб, а й у вибірковості й ексклюзивності її розповсюдження, використання для вакцинації населення (інколи винятково власних громадян, не враховуючи вразливі верстви населення, які є рези дентами цієї держави). Вакцинний націоналізм не передбачає згуртованість і коопе рацію з метою подолання пандемії COVID-19, а навпаки, диверсифікацію із глобального на локальний рівень. Необхідне повне перезавантаження світоглядного ядра конституційних цінностей у контексті тріади взаємовідносин “особа – держава – суспіль ство”. Запровадження сертифіката COVID-19 в Європейському Сою зі (ЄС) покликане ревіталізувати свободу пересування осіб, відновити бізнес та економіку держав – членів ЄС, зменшити безробіття, а також запобігти дискримінації та сегрегеції людей, сегментуванню прав людини. Мета статті – обґрунтувати запровадження сертифіката COVID-19 у ЄС як результат подолання вакцинного націоналізму за допомогою солідарності та кооперації, а також компромісу між органами влади ЄС і національними урядами держав – членів ЄС заради дотримання конституційних цінностей, забезпечення національної безпеки, гарантування прав людини та відновлення свободи пересування осіб. Гарантування універсальних прав людини, громадянство та вакцинна паспортизація (серти фікація), вакцинний націоналізм – це частина спектру тем, які викликають інтерес учених із різних держав світу (серед них варто виокремити К. Бенуа, Є. Джанкіч, Дж. МакБрайда, Л. Пікколі, Д. Рюдін, П. Спіро, С. Рейнзі, Дж. Торпі). В Україні дослідження таких питань є фрагментарними та спорадичними. Актуальності додають нещодавні рішення Європейського суд з прав людини у справі Feilazoo v. Malta (2021) і комунікації з урядами держав у справах Spînu v. Romania (no. 29443/20), Magdić v. Croatia (no. 17578/20) у контексті запровадження компетентними органами держави під час поширення COVID-19 суттєвих обмежень прав людини.
Parliamentary elections produce winners and losers. For understandable reasons, winners become the government (coalition) and losers -the opposition. the article presents a framework for comparing the rights in policy-making of the parliamentary opposition in parliamentary Central and Eastern European democracies (Czechia, Hungary, Lithuania, Poland, Ukraine). In 2022, democracy demands an opposition party with a future (reinversion) in parliament. the right of the parliamentary opposition to oppose the government formed by the governing majority is a fundamental feature of liberal democracy. Application of constitutional values (democracy, the rule of law, etc.) in Central and Eastern European states demonstrates the actual level of opposition fragmentation, polarization, and even cartelization. The present paper is offering a short account of citizenship, its history, its constitution and its main theoretical approaches. It is divided in four principal sections. The first, examines the two main theories of citizenship in their historical and normative context, thus the republican and liberal approach of citizenship as they were formed in the ancient Greek and Roman tradition, as well as in their current feminist critic. The second part focuses in the analyses of what seems up until now to be the most influential work on citizenship, the essay of the British sociologist, Thomas Humphrey Marshall "Citizenship and Social class", which was published in 1950 and since then it is considered to be the stepping stone of the international literature on citizenship. The third part presents the "constitution" of citizenship, the elements of which the notion of citizen is crafted, thus membership in a certain political community, rights and the ability of democratic participation. Finally, the last part examines the modern apprehension of citizenship, its supranational dynamic, its ability to act as a means of integration and coercion in the modern liberal democracies, while theories of pluralism, cosmopolitanism and post-nationalism are taken into account. Instead of conclusions, the paper is closing with a short postscript concerning the fallacies and prospects of a European citizenship.
