Høsten 2019 vil kunne stå igjen som tidspunktet for det endelige gjennomslaget for de «innvandrede rettskilder» 1 i norsk velferdsforvaltning.Midt i september 2019 ble Norge dømt for brudd på EMK art. 8 i storkammerets avgjørelse i Strand Lobben-saken. I desember ble Norge dømt for brudd i ytterligere to barnevernssaker. Helt siden dommen i Adele Johansen-saken i 1996 har det vaert åpenbart at EMK setter skranker for hva norsk barnevernforvaltning kan gjøre, selv om man holder seg innenfor den norske barnevernloven. De nye sakene har synliggjort at dette arbeidet ikke er ferdig. Avgjørelsene kan peke på et behov for et linjeskifte, og Høyesterett har besluttet at tre barnevernssaker samles til felles behandling i storkammer 4.-7. februar 2020.I slutten av oktober 2019 dundret trygdeskandalen inn i offentligheten. NAVs praksis har bygget på en feilaktig forståelse av EØS-rettens regler og lagt til grunn at opphold i utlandet var et selvstendig grunnlag til å miste retten til sykepenger, arbeidsavklaringspenger og pleiepenger. I skrivende stund antar man at rundt 2400 vedtak kan ha bygget på denne feiltolkningen. Et stort antall personer kan ha fått uriktig avslag på ytelser, andre har fått krav om tilbakebetaling av til dels store beløp. Saken ble ytterligere alvorlig av at det i en rekke tilfeller var reist straffesak for trygdesvindel ved at personer hadde mottatt ytelser de ikke hadde krav på. Minst 48 personer ble straffedømt for bedrageri i perioden 2014-2019, og 36 av dem til ubetinget fengsel. Opprydningsarbeidet følger nå flere spor: Et innsatsteam i NAV går gjennom saker som kan vaere berørt, internrevisjonen i NAV la frem sin rapport i desember 2019, Stortingets kontroll-og konstitusjonskomité skal behandle saken i høring i begynnelsen av januar 2020, og et eget granskingsutvalg skal legge frem sin rapport i juni.Sakene gjelder ulike rettsområder, og det arbeides på mange arenaer med å analysere feilene og hindre gjentakelser. Mens de straffe-og sikkerhetsrettslige aspektene ved terrorangrepet 22. juli 2011 har vaert grundig belyst i sakprosa og faglitteratur, har rettens mer generelle rolle i møte med 22. juli ikke blitt gjenstand for samme oppmerksomhet. Denne artikkelen skisserer en rettssosiologisk forskningsagenda ved å kartlegge de rettslige virkningene av 22. juli i lys av rettens møte med overlevende, minnearbeid og gjenoppbygging. Vi viser hvordan den norske staten og rettsapparatet i all hovedsak ser ut til å velge ordinaere virkemidler i respons til det ekstraordinaere 22. juli. Vi er interessert i hvordan retten fordeler ressurser og overprøver offentlige inngrep i sin reaksjon på 22. juli, og hvordan ulike aktører setter retten i spill i kampen om den autoritative fortellingen om 22. juli. På tross av at rettsliggjøring og rettslig mobilisering kan styrke rettigheter, viser våre foreløpige analyser at rettsliggjøringsprosesser også bidrar til å konsolidere sosiale og politiske konfliktlinjer, og kan vanskeliggjøre forsoningsprosesser i etterkant av 22. juli. Således er artikkelens formål å bidra til økt forståelse av rettens og rettssosiologiens rolle i møte med ekstraordinaere hendelser og av 22. juli som en rettslig begivenhet med konsekvenser for det norske samfunnet.
