Resumen: En este trabajo hacemos un balance crítico de algunos de los temas planteados por H.L.A. Hart en su libro Punishment and Responsibility. Concretamente, nos ocupamos de dos tesis relacionadas con los temas de responsabilidad y castigo: la tesis de la primacía de la sujeción y la tesis del carácter mixto de la justificación del castigo. Planteamos dichas tesis y revisamos su potencial explicativo a través del análisis de críticas que han recibido.
El presente trabajo tiene por objeto explorar cómo incorporan el componente ético en sus procesos de enseñanza/aprendizaje un grupo de escuelas de Derecho de la región occidental de México y, a partir de esto, concluir algunas propuestas respecto a lo que las escuelas de Derecho pueden hacer para potencializar la ética en la enseñanza jurídica. El trabajo está dividido en cinco apartados: en la primera parte, abordamos la cuestión de para qué sirve la ética a la educación jurídica; en la segunda parte, analizamos el papel de la ética en las instituciones de educación superior; en la tercera parte, presentamos el escenario de principios y/o valores que expresamente asumen estas instituciones; en la cuarta parte, reconstruimos sus estrategias de adhesión a estos principios y/o valores; y, finalmente, en la quinta parte, realizamos algunas propuestas para que la ética se incorpore a la enseñanza del Derecho. En general, argumentamos que la ética sirve al Derecho más allá de un sentido instrumental, toda vez que, con base a ella, guiamos nuestras vidas y la toma de las mejores decisiones. Se proponen acciones concretas para la inclusión de la ética profesional en el currículum y para el desarrollo de acciones que permitan que la adhesión de las instituciones a la ética se convierta en una realidad palpable.
Esta reseña analiza una serie de reflexiones, elaboradas por doce diferentes autoras, acerca de algunos aspectos sustantivos de las teorías tradicionales de derechos humanos. Estos aspectos son sistematizados en torno a los siguientes apartados: La relevancia de la perspectiva iusfilosófica en la revisión crítica de las concepciones sobre derechos humanos; el problema de la fundamentación de los derechos humanos; el problema del carácter absoluto como propiedad esencial de estos derechos; el temor de que los derechos fundamentales pierdan su papel de límite ante intereses de tipo colectivo; la dignidad humana como principio que posibilita, pero que también restringe, la autonomía individual; el ejercicio efectivo de la autonomía frente al presupuesto del agente autónomo; el problema de la universalidad de los derechos humanos en un contexto de pluralidad y diversidad; la importancia del orden internacional; y el rechazo a una concepción de los derechos y los deberes en términos estatistas y de correlación.
En el presente documento, se explora la acusación de que las reivindicaciones a favor de las mujeres tienen un tinte punitivo, en el sentido de que pretenden combatir los estereotipos de género a través de los medios más coercitivos del Estado, exigiendo, además, que este restrinja los derechos individuales de los procesados para lograr más castigos y más severidad en ellos. Desde el contexto mexicano, se analiza si, en efecto, las pretensiones a favor de las mujeres implican el debilitamiento de garantías, específicamente, de una tan importante como la derivada de la protección del derecho de presunción de inocencia de los individuos sujetos a un proceso penal por delitos que implican violencia hacia las mujeres.
