Minél inkább kerül a környezeti politika a kormányzati (pénzügyi) politika homlokterébe, annál inkább érvényesülnek benne a kormányzást magát meghatározó érdekviszonyok. Az Európai Unió keretében ez mindenekelőtt úgy valósult meg eddig, hogy a tagállamok kormányzati politikai szerepe sok esetben inkább önmagáért valóan növekedett, és nem pedig a gyakran hivatkozott környezetvédelemre valóban való ösztönzés érdekében. A környezeti felelősség mintha a szebbik, a pénzügyi szabályozások valósága pedig az árnyasabb oldalát mutatná a tényleges kormányzati céloknak.
National interest, also as a critisism against the pradigm of New Public Management (NPM), is very much emphasised nowadays in public policies, even in sector ones. This article is about a removal from the classical meaning of general (public) interest to that new approach represented by certain EU Member States and the reasons behind. Our analysis focuses on contextual motives and impacts of these changes illustrated by the Hungarian case. The result shows that the market of public utility services has already been influenced by direct political considerations. Our findings indicate that these understandings for legitimate influence on EU market rules can also be derived from the legal framework itself. Measures examined in the paper run completely counter to the spirit of the original intention of the founders of the integration, and recent changes in EU law do not seem to raise unavoidable obstacles to such cases. Lessons of this case may be relevant for other EU Member States as well, at least for those from the Central-European region.
Rules on services of general interest allow exceptions to the internal market law of the European Union. Do these exceptions really remain within the limits of free competition? Nowadays, this question seems not to be independent from the risk of direct political considerations influencing the market of public services. This tendency may result in national legislative or administrative measures that may run counter to the spirit of the original objectives of European Union integration. European Union substantive and procedural law does not seem to raise unavoidable obstacles to such efforts. In the context of the European Union regulatory framework for services of general interest, our research focuses on the results of an analysis of a database of European Union court cases that highlights the challenges and threats of recent national instruments of public sector organization to the operation of the European Union internal market and competition rules.
A 20. század második fele és a 21. század eleje meghatározó jelentőséggel bírt az egyes államok felsőoktatási rendszerének formálódásában, illetve az európai egyetemek mai arculatának kialakulásában. Egymással párhuzamosan jelentkező hatások, háttérfolyamatok eredményeként a hagyományosan nemzetállami szinten szabályozott felsőoktatás egyfajta „európaizálódásának” folyamata zajlik; mindeközben pedig az európai egyetemek tevékenysége mind tartalmilag, mind szervezési kereteit tekintve átalakul.
