The relevance was the study is conditioned by the strengthening role of contractual regulation of intellectual property relations in the information society and the transition to an innovative development of the national economy. The purpose of this study is to identify the features of the contract as a legal tool in the mechanism of legal regulation of intellectual property relations at different stages. In the context of the analysis of the contract as a means of regulating relations in intellectual property, emphasis is placed on the expediency of distinguishing two groups of legal relations: those that mediate statics, i.e. ownership of rights to intellectual property, and those that mediate the dynamics, i.e. transfer of rights to intellectual property from one subject to another. It is noted that the contract is perhaps the most important legal means of commercialisation of rights to intellectual property, ensuring the effective implementation of creative activities in production and other areas of public life to meet the private interests of their creators, those who invested in their creation, and public interests. A rising tendency is noted to use the contract as a remedy at the stage of protection of rights to intellectual property. The parties may stipulate ways to protect their rights in the contract on the disposal of rights to intellectual property, which are not stipulated by law, regulate the procedure for resolving disputes, etc. Thus, the contract is an effective remedy at all stages of governing intellectual property relations – in the legal regulation of these relations, the acquisition of rights to intellectual property, the exercise of these rights, as well as their protection. The results of the analysis conducted in this study can be used in further research on contractual regulation of intellectual property relations, as well as in law-making to improve national legislation on intellectual property, which is especially important in the context of recodification of civil legislation of Ukraine
In order to increase the material benefits, in order not to pay taxes or to pay less, in order to conceal information and for other purposes, the parties entering into legal relations become participants in mock transactions. The practise of mock transactions is to replace the conclusion of a single document, such as a sale one, with the conclusion of a contract of charitable contribution. The practise of using mock transactions is quite common and it is almost impossible to prove the nature of the transaction. Therefore, this work is aimed at investigating the institution of the mock transaction, as well as to develop recommendations for the practical application of the rules governing this institution. To conduct this study, the materials of the practise of dispute resolution on the application of the consequences of fictitious transactions by the courts of Ukraine, the dialectical method of cognition, the formal-legal method, the hermeneutic-legal method were used. As a result of research the signs of mock transactions, approaches of detection of fictitious transactions are established. It can be concluded that the distinguishing feature of fictitious and mock transactions is the orientation of the will of the parties to the transaction on the occurrence of legal consequences.
Introduction. Along with the creation of intangible objects, their effective introduction into production and other spheres of public relations to satisfy both the private interest of creators, the persons who have invested the funds in their creation, and the public interest acquire the particular importance.Problem Statement. The study of intellectual property policy in the activities of universities and research organizations now receives serious attention, in particular by institutions such as the World Intellectual Property Organization and the European Union.Purpose. The purpose of this research is to identify regulatory requirements and scientific approaches to the formulation of intellectual property policy of higher education establishments and R&D institutions of Ukraine, as well as proposing measures to improve the effectiveness of this policy.Materials and Methods. Analytical analysis of current regulations and scholarly research works in order to develop proposals for improving the effectiveness of intellectual property policy in the activities of higher education establishments and R&D institutions of Ukraine.Results. It is disputable that in the case of the conveyance of intellectual property rights as a contribution to the authorized capital of legal entities, such property rights “shall be held by a state-owned R&D institution or university, academies, institutes”. After all, if any assets are conveyed as a contribution to the authorized capital of a corporation, the titles to these assets are transferred to the corporation.Conclusions. The positive legislative trends in the educational field provide for strengthening the positions of education establishments and R&D institutions in terms of the commercialization of scholarly research and R&D results.
The article analyses the civil law means of protecting the ownership rights to intellectual property from the standpoint of Ukrainian law and practice. The focus is on those means of protecting intellectual property rights envisaged by the Association Agreement between the EU and the eaec and their Member States, of the one part, and Ukraine, of the other part, and outlines the prospects for their practical implementation within the legal framework of Ukraine. Among the means of protecting intellectual property rights, prohibition of the misuse of intellectual property in a specific way is considered. The paper also analyses the ways of protecting intellectual property rights, which are aimed at restoring the situation that existed prior to their violation, in particular, the removal from the civil circulation of goods manufactured or put into civil circulation, thus causing a violation of intellectual property rights, and subsequent destruction of such goods.
Стаття присвячена дослідженню питання про оновлення законодавчих підходів до закріплення видів об'єктів права інтелектуальної власності в умовах рекодифікації цивільного законодавства України. Враховуючи міжнародно-правові зобов'язання України та євроінтеграційний вектор розвитку її національного законодавства, до об'єктів права інтелектуальної власності мають у будь-якому разі бути віднесені об'єкти авторського права (включаючи комп'ютерні програми і бази даних), об'єкти суміжних прав, винаходи, промислові зразки, компонування напівпровідникових виробів, сорти рослин, ноу-хау. Objects of intellectual property rights from the standpoint of the recoding of civil legislation of UkraineThe article is devoted to the study of the issue of updating the legislative approaches to the consolidation of types of objects of intellectual property rights in terms of recoding the civil legislation of Ukraine. Given the international legal obligations of Ukraine and the European integration vector of development of its national legislation, the objects of intellectual property rights should in any case include copyright objects (including computer programs and databases), objects related rights, inventions, industrial designs, arrangement of semiconductor products, plant varieties, know-how. The expediency of removing scientific discoveries and innovation proposals from the number of objects of intellectual property rights, as well as supplementing the types of such objects with domain names has been proved.
