As a consequence of its long history of more than 250 years, the Douro Demarcated Region (NE Portugal) boasts a distinct cultural landscape typified by terraces filled with the regional variety of grapevine – it is a region where famous wines are produced, in particular Port wine. Nevertheless, especially after the 1980s, the need to cover labour shortages and increase productivity led to a gradual change in the landscape, and today the traditional terraces are mixed with new types of vineyards, such as the “vinha ao alto” (vertical vines) and “vinha em patamares” (vines on terraces). Against this backdrop, and with a view to preserving the landscape in a sustainable and multifunctional way, UNESCO awarded the region the “Evolving Living Landscape, World Heritage” award. In this article we combine extensive documentary research with productive field work in order to question the relationship between the need to preserve an exceptional, cultural landscape and the need for regional sustainability in this World Heritage site.
In a wine producing region like the Douro Valley (NE Portugal), embedded in the schist-greywacke complex of the Douro-Beira district and the source of high-quality mineral and spring waters, what is the strategic positioning of health and wellness tourism? What is the importance of thermal baths in the revitalisation of rural areas, and who are the main agents behind these dynamics? These are the main questions we will address in this article. Relatively overlooked until recently, health and wellness tourism has been growing in relevance in Europe and Portugal in the 21st century and is now considered a strategic product. Thermal baths were traditionally restricted to therapeutical treatments, but well-being has become a core concern today. Thermal bathhouses and resorts can be found throughout Portugal, four of which are located in the Douro region. Furthermore, their revitalisation bolsters sustainable development of Portugal’s inland regions, “reclaiming” an activity with a centuries-long history under a new paradigm. To achieve the study’s goals, we have combined documentation research with fieldwork, including semi-structured interviews conducted with the main actors involved in these dynamics.
Questão central das relações laborais, o tempo de trabalho constitui um enjeu conflitual, com os sindicatos a visarem a sua redução e o patronato a enfatizar a necessidade da sua flexibilização no quadro da flexibilização da relação salarial.
Nas últimas décadas tem-se assistido a uma profunda reorganização do tempo de trabalho, que vem sendo regulado segundo vários modelos que articulam negociação coletiva, intervenção estatal e processos de concertação social.
Na administração pública portuguesa as relações laborais modificaram-se profundamente. Primeiro, sob o impulso do New Public Management; posteriormente no contexto da crise iniciada em 2008 e da intervenção da Troika.
Neste sector, as condições de trabalho foram tradicionalmente definidas por via legislativa, em consonância com os vínculos contratuais existentes. Com a aproximação do regime laboral ao do sector privado, o direito à contratação coletiva foi outorgado pela Lei n.º 23/2004 de 22-06, mas somente aos trabalhadores com contrato de trabalho em funções públicas. Contudo, quer este diploma quer a Lei n.º 59/2008 de 11-09 (RCTFP) impuseram algumas especificidades, em particular restringindo as matérias objeto de negociação.
O objetivo desta comunicação é evidenciar as principais tendências de regulação do tempo de trabalho que emergem da negociação coletiva neste sector. Ela baseia-se numa análise documental das convenções coletivas negociais publicadas no DR entre 2009 e 2015, bem como de outros documentos.
Serão referidas algumas conclusões relevantes no atinente aos padrões de regulação existentes. Não deixará de ser evidenciada igualmente a política unilateral seguida pelo anterior governo desde 2013. Depois de impor as 40 horas de trabalho semanais, recusou-se a homologar algumas centenas de convenções livremente negociadas prevendo a manutenção das 35 horas, até que um Acórdão do Tribunal Constitucional veio considerar inconstitucional a norma em que esse veto se baseava. Entretanto, já havia admitido a possibilidade das 35 horas em troca da aceitação pelos sindicatos da adaptabilidade do tempo de trabalho. Nos últimos meses da sua governação foram assinadas pouco mais de uma dezena de convenções neste contexto.
