Dies hängt mit Unklarheiten, die bereits im Hinblick auf Grundeigenschaften der Kriminologie bestehen, zusammen. Was mit „Kriminologie“ gemeint ist und wofür sie zuständig ist bzw. zuständig sein könnte, ist nicht offenkundig. Ebenso existiert Klärungsbedarf dazu, wer die Kriminologie vertritt, und ob es sich bei der Kriminologie überhaupt um eine eigenständige Wissenschaft handelt, was Voraussetzung für eine Einordnung als „forensische Disziplin“ wäre. Auch lohnt ein Blick auf die Verbindlichkeit von Erkenntnissen, die als „kriminologisch“ eingeordnet werden. Mit einem Hauptaugenmerk auf diesen Aspekten widmet sich folgender Beitrag der Rolle der Kriminologie in der Forensik. Es ist demzufolge an der Zeit, sich von der konturenlosen Rechtsfigur der elektiven Konkurrenz zu verabschieden und zu den Grundwertungen und Prinzipien des BGB zurückzukehren.
