O trabalho pretende realizar uma leitura constitucional crítica sobre o debate da redução da maioridade penal em face do conceito de estado de exceção. Para tanto, será feita breve apresentação do conceito de “estado de exceção”, proposto por Giorgio Agamben. Na sequência, o trabalho adentrará no debate da maioridade penal, tendo em vista o contexto pós-democrático em que o Brasil se insere, e as perspectivas de futuro que se vislumbram a partir dos resultados das eleições de 2018 para o Congresso Nacional e a Presidência da República.
Resumo Este artigo visa analisar a interrupção voluntária de gravidez a partir do Novo Constitucionalismo Latino-Americano (NCLA), realizando um estudo de caso da Sentença Constitucional Plurinacional 0206/2014 (Bolívia). Para tanto, faz-se breve análise do modelo constitucional e apresenta-se o debate do aborto, analisando, após, o precedente boliviano. Ao final, é feita análise crítica da decisão, destacando pontos relevantes e controvertidos.
Analisa-se a teoria da associação diferencial desenvolvida por Edwin Sutherland, seus desenvolvimentos posteriores e as implicações das teorias da aprendizagem no Direito Penal Econômico. Nesse sentido, são apresentadas as origens históricas e sociológicas da associação diferencial; suas configurações ao longo dos estudos de Sutherland e suas críticas, correções e atualizações para, ao final, levantar o legado da teoria associação diferencial para a Criminologia contemporânea e propor possibilidades de aproveitamento das teorias da aprendizagem no Direito Penal Econômico.
