The method used in this research is using normative juridical approach, the specification of the research is descriptive analytical.Based on the findings of the Judicial Commission has the concept of preventive surveillance by the repressive, namely to prevent and then are giving emphasis and contain sanctions. The Judicial Commission has the authority to give the sanction of ethics recommendations to the Supreme Court but the repressive ie without the MA recommendations, the recommendations of the Judicial Commission to be worth sia. Cooperation and there is no obvious surgical realm between the Supreme Court and the Judicial Commission.
The most state revenue is from the tax sector. The government has tried its best to increase revenue from the tax sector from year to year. However, the development of tax variations by the government must not ignore the principle of equity. Likewise, in the imposition of e-commerce tax, the government is based on the principle of equity. To achieve these objectives this research uses an exploratory approach. With a qualitative explorative method this research produces explorative analytic data. Activities in analysing this include reducing the data obtained by looking at the concepts and development of the application of the principle of equity in the imposition of e-commerce tax and then presenting data that can provide definitions or explanations about the concepts or patterns studied in the study. The results of this study are the rejection of e-commerce actors against ministerial regulations that impose e-commerce tax because it is considered to have no principle of equity in the ministerial regulations. The existence of the principle of equity that is not considered in this ministerial regulation results in the e-commerce tax not working. Therefore, improvement of ministerial regulations governing the imposition of e-commerce tax must be made more holistic by applying the principle of equity in every joint of e-commerce tax provision.
Public Service rules state that an Ombudsman can settle a dispute involving public services. Since the decision has value as a suggestion, the Ombudsman's findings are given as recommendations. Then, legal action may be taken according to the law. This study examines how the ombudsman's recommendations as an independent oversight agency affect public service delivery in Indonesia. This study employed a normative legal technique to compare the Ombudsman's recommendations to regulations, legal principles, legal theories, and other literature. The Ombudsman oversees the implementation of public services organized by State Administrators and government at the center and in the regions, including those held by State-Owned Enterprises, Regional-Owned Enterprises, and State-Owned Legal Entities, as well as private entities or individuals tasked with administering public services. The Ombudsman supervises public service delivery and resolves disputes. The Ombudsman uses Mediation and Adjudication to resolve public service problems. However, the Ombudsman is not a court, thus in order to provide recommendations, it is important to acknowledge this. The Ombudsman's recommendation isn't legally binding. Although the steps from a report to the Ombudsman's suggestion are similar to court verdicts, the Reported Party and its superior who don't follow the advice face administrative punishment. On this basis, it is necessary to analyze the Ombudsman's authority, the position of his mandated recommendations, and the Indonesian rule of law's legally enforceable definition.
Kelurahan Magersari, Kecamatan Magelang Selatan, Kota Magelang merupakan salah satu daerah yang sering terjadi konflik sosial, baik kekerasan maupun kejahatan. Salah satu penyebab konflik sosial di Kelurahan Magersari adalah minimnya pemahaman masyarakat akan pentingnya kesadaran hukum yang harus diterapkan dalam bermasyarakat. Kondisi ini berakibat pada munculnya perilaku dari warga masyarakat yang bertentangan dengan peraturan perundang-undangan. Kegiatan pendampingan yang dilaksanakan oleh Tim Pengabdian Pada Masyarakat Terpadu (PPMT) Universitas Muhammadiyah Magelang bertujuan untuk meminimalisir terjadinya konflik sosial di Kelurahan Magersari. Tim PPMT bekerjasama dengan Lembaga Keswadayaan Masyarakat (LKM) Magersari dan komunitas PKK dalam memberdayakan masyarakat di Desa Magersari. Kegiatan ini dilakukan dengan sosialisasi, pendampingan melalui pembentukan pos kajian hukum (posjikum) dan pelatihan mediator. Kendala yang dihadapi oleh Tim PPMT adalah di tengah pelaksanaan pendampingan muncul wabah Covid-19 yang berdampak pada tidak optimalnya pendampingan. Namun demikian, Tim PPMT mengalihkan sebagian kegiatan dengan bakti sosial membagikan masker, sabun cair anti bakteri dan cairan disinfektan kepada masyarakat dan pejabat kelurahan. Hasil pelaksanaan kegiatan berdampak positif bagi masyarakat Desa Magersari. Sebanyak 2 (dua) konfllik sosial yang terjadi dapat terselesaikan secara damai melalui mediasi, selain itu masyarakat Desa Magersari secara mandiri juga dapat membuat dokumen hukum berupa dokumen kontrak, permohonan penetapan pengadilan, surat kuasa dan surat gugatan.
