Patientengeheimnis und DokumentationspflichtDie Pflicht des Arztes, über dasjenige zu schweigen, was der Patient ihm anvertraut oder was er bei Ausübung seines Berufes erfahren hat, wird gerne als die älteste bekannte Datenschutzvorschrift bezeichnet. Ihr Ausgangspunkt ist das unverzichtbare Vertrauen zwischen Arzt und Patient, ohne das der Heilungserfolg nicht gelingen kann 1 . Es gehört zu den kulturellen Errungenschaften der Menschheit, daß sich der Patient dem Arzt gegenüber unbesorgt offenbaren kann.Rechtlich beruht die ärztliche Schweigepflicht auf mehreren Säulen. Zum einen verpflichten die ärztlichen Berufsordnungen zur Verschwiegenheit 2 , zum anderen stellt das Strafgesetzbuch Verletzungen dieser Pflicht unter Strafe. Daneben sind das aus dem allgemeinen Persönlichkeitsrecht folgende, in der Verfassung garantierte Recht auf informationelle Selbstbestimmung und das einfache Datenschutzrecht zu beachten.Zwar ist das Bundesdatenschutzgesetz gemäß § 1 Abs. 2 Nr. 3 nur anwendbar, wenn es sich um die Verarbeitung von Daten in oder aus Dateien handelt. Beim heutigen Stand der Automatisierung der Datenverarbeitung in Krankenhäusern und Arztpraxen ist allerdings kaum noch Datenverarbeitung vorstellbar, die wegen fehlenden Dateibezugs nicht unter den Anwendungsbereich des Bundesdatenschutzgesetzes fällt 3 .Auch Art. 8 der Richtlinie 95/46/EG des Europäischen Parlamentes und des Rates vom 24. 10. 1995 zum Schutz natürlicher Personen bei der Verarbeitung personenbezogener Daten und zum freien Datenverkehr sieht "Daten über die Gesundheit" als besonders schützenswert an.Inhaltlich schöpft das Patientengeheimnis also aus mehreren Quellen. Im Kern bedeutet es, daß der Arzt Informationen, die unter das Patientengeheimnis fallen, Dritten nur dann offenbaren darf, wenn er gesetzlich dazu ausdrücklich (insbesondere "normenklar") befugt ist oder mit Einwilligung des Patienten handelt.Letztere kann häufig unterstellt werden, wenn mit-oder nachbehandelnde Ärzte zu informieren sind, Labore und Röntgeneinrichtungen eingeschaltet werden müssen oder bei einer Behandlung im Krankenhaus das beteiligte Team unterrichtet sein muß. Die Tatsache, daß es sich bei dem Dritten ebenfalls um einen Arzt handelt, schafft für sich allein gesehen kein Offenbarungsrecht. Die Schweigepflicht gilt auch unter Ärzten 4 .Was das ärztliche Hilfspersonal betrifft, so darf es im erforderlichen Umfang nur informiert werden, wenn es tatsächlich den Weisungen des Arztes unterliegt. Dies ist, wenn es um EDV-Personal geht, das zur Installation, Wartung, Reparatur oder Administration von EDV-Systemen eingesetzt wird, regelmäßig nicht der Fall. Denn mangels eigener Sach-und Fachkenntnis kann der Arzt häufig deren Arbeit nicht überwachen.Der Bundesgerichtshof hat in den vergangenen Jahren, wenn es um Inhalt und Reichweite der Schweigepflicht ging, im Zweifel stets einen strengen Maßstab angelegt und sogar die Abtretung von Honorarforderungen 5 oder die Übergabe von Krankenunterlagen an den Praxisnachfolger 6 von der ausdrücklichen Einwilligung 7 der Patient...
