O presente artigo objetiva analisar o Regime Internacional dos Refugiados, abordando sua emergência nas relações internacionais e sua internalização no Estado brasileiro, por meio de um estudo de caso qualitativo. Assim, a partir do modelo analítico construtivista do Ciclo de Vida das Normas, proposto por Finnemore e Sikkink, o trabalho explora o processo de emergência, propagação e internalização das normas relativas à proteção dos refugiados no mundo e, sobretudo, no Brasil. Tal regime começou a ser construído no século XX, se consolidando a partir da Convenção de 1951, relativa ao Estatuto dos Refugiados, e foi disseminado e ampliado pela comunidade internacional, tendo suas normas adotadas por diversos Estados, influenciando mudanças em suas legislações domésticas. Ainda que o Brasil tenha sido um dos primeiros países a aderir ao regime, passou por um longo e gradual processo de internalização. Mudanças significativas em sua postura somente ocorreram após o término do período ditatorial, sobretudo com a positivação dos compromissos assumidos internacionalmente pelo país na forma de uma lei interna voltada ao refúgio. A pergunta que orienta o artigo é: como se dá a internalização do Regime Internacional de Refugiados pelo Brasil? Conclui-se que, atualmente, apesar de possuir um ordenamento jurídico sobre o tema considerado pioneiro – por adotar uma definição ampliada de refugiado e conceder importantes direitos à essa população – o país opta por adereçar um dos maiores contingentes de deslocamentos forçados de sua história por outros meios, díspares ao instituto do refúgio, se distanciando, assim, deste regime internacional. Abstract: This paper analyses the International Refugee Regime, covering its emergence in the international relations and its internalization in Brazil, through a case study. Therefore, applying the Norm Life Cycle analytical model developed by Finnemore and Sikkink the article explores the emergency, diffusion, and internalization processes of norms related to refugee protection around the world and, more specifically, in Brazil. The refugee regime began in the early twentieth century and its tipping point occurred with 1951 Convention Relating to the Status of Refugees; throughout the years, the regime was spread and broadened by the international community and its norms were adopted by many states, influencing changes in their domestic legal systems. Even though Brazil was one of the first states to adhere to the regime, it went through a long and gradual internalization process. Significative changes in its posture only occurred after the end of the country’s military dictatorship, notably when its international commitments were transformed into a domestic law regarding refugees. The main question this article seeks to answer is: how do Brazil internalize the International Refugee Regime? The paper concludes that despite having a domestic law perceived as pioneer on this matter – due to the adoption of a broader refugee definition and the safeguard of important rights to that population – the country chooses to address one of the largest contingents of forced migrants of its history through other mechanisms other than refuge; hence, distancing itself from that regime. Os Direitos Humanos são princípios que orientam ou devem orientar as ações dos Estados, sociedades e indivíduos, porém, estes não possuem necessariamente o poder de configurar obrigações jurídicas. Bucci (2001) argumenta que para transformá-los de princípios em instrumentos com poder de regra, é necessário estabelecer políticas públicas para direitos humanos. Assim, este trabalho busca verificar a hipótese da autora através de um estudo de caso sobre o sistema de refúgio no Canadá a fim de observar os efeitos causados pela construção de uma política pública apropriada para abordar o problema em questão. O país, que aderiu tardiamente aos acordos internacionais sobre o refúgio, não somente adequou-se às normas propostas pela comunidade internacional, comotornou-se referência na recepção, proteção e reassentamento de refugiados.Palavras-chave: Políticas Públicas, Direitos Humanos, Canadá.ABSTRACTHuman Rights are principles that guide, or should guide, the actions of States and societies and individuals, but they don’t necessarily have the power to create judicial obligations. Bucci (2001) states that the path to transform them from principles to tools with legal power, it is necessary to develop public policies for human rights. Therefore, this work aspires to verify the author’s hypothesis through a case study on Canada’s refuge system to observe the effects of the development of an appropriate public policy to this end. A discussão sobre como melhor proteger o ser humano e sua dignidade das injustiças perpetradas pelo de- senvolvimento assimétrico das diferentes nações e sociedades se tornou um dos destaques da agenda internacional a partir do fim da Guerra Fria. Nesse contexto, começam a emergir, no âmbito das Nações Unidas, pautas de Direitos Humanos que anteriormente se encontravam limitadas ao campo do Direito Ambiental, como o direito humano ao ambiente sadio, ainda não reconhecido formalmente. Este artigo busca compreender quais são as conexões existentes entre os dois campos e se os direitos referentes ao Meio Ambiente devem ou não ser considerados indivisíveis em relação aos demais Direitos Humanos, sendo está uma das condições sugeridas pelo Conselho de Direitos Humanos da Organização das Nações Unidas (ONU). A discussão proposta por este artigo é de caráter teórico-conceitual, no intuito de fornecer maior clareza sobre as interseções existentes entre os dois campos mencionados previamente, e é realizada através de análise documental e bibliográfica.
O objetivo deste trabalho é analisar, a partir de uma perspectiva construtivista, qual lógica orientou o comportamento brasileiro no tratamento desta questão desde os anos 1950 até o governo Dilma Rousseff (2011-2016). Utilizando a abordagem de Alexander Wendt e de Martha Finnemore sobre lógica da adequação e lógica das consequências, este artigo parte da constatação de que embora o Brasil seja reconhecido como um país que historicamente respeita os direitos humanos e acolhe refugiados, nem sempre o seu comportamento refletiu uma abordagem solidária e alinhada às normas para tratamento do tema. Durante diferentes fases, a lógica das consequências se impôs na política externa brasileira, limitando a adesão do Brasil às normas internacionais que regulamentavam a acolhida aos refugiados e guiando suas ações para viés mais pragmático do que humanitário. A partir dos anos 1990, com o processo de redemocratização e reforço dos direitos humanos como tema central no ordenamento doméstico e internacional, a política brasileira para refugiados orientou-se conforme a lógica da adequação, refletindo um processo mais amplo de participação ativa do Brasil na ordem internacional. No entanto, conclui-se que a lógica da adequação ainda convive com a lógica das consequências na política brasileira para refugiados.
