E l intento actual de América del Sur de conformar un bloque regional que abarque a todos los países sudamericanos -y solamente a estos países-es una importante evolución en la errática historia de la integración en este subcontinente. El surgimiento y la creciente relevancia de la Unión de Naciones Suramericanas (Unasur) responden, fundamentalmente, a tres factores primordiales.El primero es el paulatino agotamiento de la efectividad y del consenso en torno al sistema interamericano actual. Si bien es verdad que hace décadas que se habla de la crisis del consenso interamericano, en particular en América del Sur, los últimos años han sido particularmente desgastantes. La Organización de Estados Americanos (OEA) se ha convertido en la gran víc-tima de este creciente hastío sudamericano respecto de las estructuras establecidas a partir de 1948.En realidad, la crisis del multilateralismo no esta solamente restringida al hemisferio occidental y a América del Sur, tratándose más bien de un fenómeno global. Probablemente, el evento que mejor ilustra esta situación política fue la manera como los Estados Unidos reaccionaron frente a los atentados de 2001 en Nueva York. No obstante, esta crisis ha sido particularmente notoria en nuestra región, donde todas sus organizaciones multilaterales han sido cuestionadas o se han visto rebasadas, en algún momento, por acontecimientos que no han podido procesar. El caso de la Comunidad Andina de Naciones (CAN), por ejemplo, es dramático. Desde hace casi dos décadas, no ha podido dar cuenta de ninguno de los eventos políticos relevantes en la región: el conflicto Ecuador-Perú, en su momento; la polarización venezolana; el violento conflicto colombiano; la inestabilidad política de Ecuador y Bolivia; el autoritarismo de Fujimori en Perú; y las tensiones fronterizas de Colombia con sus vecinos.Parecería que no se trata exclusivamente de un problema de capacidad política, pues las organizaciones multilaterales estuvieron históricamente vinculadas a una idea de integración entendida en términos liberales y regida por prioridades comerciales. La adscripción de los países latinoamericanos a las dinámicas de la globalización, por una parte, y los pobres resultados del modelo de desarrollo neoliberal, erosionaron también los escenarios multilaterales. El tema, en términos de la literatura clásica y convencional sobre integración, es que ni las sociedades latinoamericanas ni sus organismos internacionales pudieron construir mecanismos eficientes -más allá de los bilaterales-para procesar temas transnacionales 1 . En este contexto es importante señalar que los gobiernos de América del Sur recibieron, con creciente beneplácito, la llegada de nuevos actores extra regionales. 1 Ernst Haas (1958) plantea que la integración supone la transferencia de lealtades, expectativas y actividades a una institucionalidad supranacional que tiene jurisdicción superior a la de los estados. En América del Sur, ninguna de las organizaciones existentes habría cumplido este requisito.
Este estudio analiza la situación jurídica del Tratado Constitutivo de la Unión de Naciones Suramericanas (Unasur) luego de las denuncias realizadas —o anunciadas— por parte de distintos Estados miembros; realiza un recorrido por los motivos que llevaron a su creación y reflexiona sobre las razones actuales de la necesidad de su subsistencia como único marco jurídico multidimensional hacia una integración suramericana permanente. Para arribar a sus conclusiones analiza los procedimientos internos de denuncia; el estatus de sus miembros fundadores en relación con el Tratado Constitutivo de la organización; y la vigencia de la organización. El estudio concluye que los Estados debieron recurrir al diálogo político y al mecanismo de solución de controversias previsto en la Tratado Constitutivo —opción que se mantiene aún vigente—debido a que constituye la vía institucional idónea para destrabar conflictos.
