RESUMENEl artículo que presentamos pretende acercar a los estudiantes que se enfrentan por primera vez a la traducción de textos jurídicos, en la combinación lingüística francés/español, al contenido temático que rodea la traducción de textos con origen o destino en los ordenamientos jurídicos de Francia y España, con objeto de desarrollar la competencia temática (Kelly 1999(Kelly , 2002(Kelly , 2005. Esta necesidad surge principalmente de las divergencias entre ordenamientos jurídicos, así como del recelo por parte de los estudiantes al acercarse a una disciplina que les suele provocar rechazo.Palabras clave: traducción de textos jurídicos, competencia temática, ordenamientos jurídi-cos francés y español. Subject area competence in legal translation training in theFrench/Spanish language combination ABSTRACT This paper aims to bring students who are facing for the first time translation of legal texts, in the French/Spanish language combination, closer to the thematic content surrounding the translation of legal texts originating or targeting the Spanish or French legal systems, as a means to develop subject area competence (Kelly 1999(Kelly , 2002(Kelly , 2005. This need arises mainly from the divergences existing between legal systems and from the fear showed by students who are facing a discipline they usually reject.
Legal translation training involves the acquisition and development of a set of sub-competences that constitute legal translation competence (Cao, Deborah. 2007. Translating law. The development of those sub-competences is part of a complex process where students are faced with different concepts and translation strategies and techniques which are not necessarily easy to grasp for trainee translators (Way, Catherine. 2014. Structuring a legal translation course: A framework for decision-making in legal translation training. In Le Cheng, King Kui Sin & Anne Wagner (eds.), The Ashgate handbook of legal translation. Farnham: Ashgate), particularly when applied to a legal context. It is our experience that translation students tend to focus on the product (text production) and do not spend enough time analysing the source text, which results in obvious mistakes in mainly – but not only – cultural (legal), textual and linguistic aspects. The interdisciplinary nature of legal translation calls for an integrative model for teaching and learning. The model presented provides trainees with a framework for source text analysis that places the communicative situation and the translation brief at the core from which three fundamental dimensions, based on the aspects mentioned above, develop. Elements such as the legal cultures involved, legal text typologies or the level of specialisation of terms and discourse are some of the aspects to be considered, so allowing trainees to achieve a thorough understanding of the source text for a conscious translation. The model will be applied to a specific source text and translation brief.
O objetivo do presente artigo é propor um programa formativo para tradutores de textos jurídicos a partir da análise da competência tradutora em tradução jurídica. Para isto, antes de analisar o desenvolvimento das áreas competentes que entram em jogo na tradução jurídica, recordaremos porque cabe diferenciar a tradução jurídica da tradução de outros tipos de textos e repassaremos argumentos que defendem a idoneidade, para o tradutor jurídico, de contar com uma formação que seja estritamente tradutológica, estritamente jurídica ou bem uma combinação de ambas. A proposta formativa que oferecemos pode ser adaptada a qualquer formato e duração e está dirigida tanto a egressos de direito como em tradução ou a tradutores profissionais que não trabalham com textos de caráter jurídico.
En la gran mayoría de planes de estudios de los grados en Traducción e Interpretación de las universidades españolas constan asignaturas que, con mayor o menor profundidad, abordan la traducción de textos jurídicos. Sin embargo, y al igual que ocurre con otras áreas de especialidad también en el ámbito de la traducción y la interpretación, no se suelen ofrecer asignaturas específicas orientadas a desarrollar la subcompetencia temática en esos ámbitos concretos. Como consecuencia, los estudiantes generalmente afrontan la traducción de textos jurídicos con un desconocimiento casi absoluto del derecho. Aunque existen estudios previos que abordan algunos aspectos relativos a la formación en traducción jurídica en general (Monzó Nebot, 2008; Prieto Ramos, 2009; Cao, 2014; Soriano Barabino, 2018, 2020a, 2020b; Way, 2000, 2016) o a la adquisición y desarrollo de la subcompetencia temática en el ámbito y la combinación lingüística que nos ocupa (Barceló Martínez y Delgado Pugés, 2017a; Soriano Barabino, 2013; Valderrey Reñones, 2003, 2004, 2017), el objetivo de este artículo es realizar una propuesta didáctica para que los estudiantes de los grados en Traducción e Interpretación comiencen a adquirir la subcompetencia temática necesaria para traducir textos jurídicos a través de actividades no necesariamente “de traducción”, el análisis y la comprensión de textos pertenecientes a un procedimiento jurídico concreto y a lo largo de las asignaturas enfocadas a la traducción de textos jurídicos (que a menudo no cuentan con un gran número de créditos). Para ello, nos centraremos en un ámbito específico, el del derecho de sucesiones. La propuesta podrá ser extrapolable a otros ámbitos y combinaciones lingüísticas.
