Obgleich nuch schon bei den gcwollten Eingriffen die Pflicht zur größtmöglichen Schonung und Gcringhalrung des Aufopfcrungssciiadcns besteht 11 , ist es im Unterschied dazu 12 ein Wcscnsmcrkmal der Gcfährdungshaftung, daß der Eintritt eines Schadens überhaupt unter Aufbietung aller möglichen und zumutbarcn Schutzmaßnahmen und Sorgfalrspllichtcn vermieden werden muß.Wenn es bei der beschlossenen Fristenregclung das erklärte Ziel des Gesetzgebers ist, auf die Dauer die Gesamtzahl der Abtreibungen einzudämmen 23 , dann wird er auch alle "von der Rechtsordnung zur Verfügung gestellten Mittel 4184 anwenden müssen, um die strafrechtlich freigegebene Entscheidung der Schwangeren zugunsten des werdenden Lebens zu beeinflussen. Wenn der strafrechtliche Schutz entfällt, sollte zumindest derjenige privatrechtliche oder sozial rechtliche Schutz in Erwägung gezogen werden, der bei gleichartigen Interessenkonflikten seine Wirkung entfaltet und darin besteht, daß für die Verletzung eines Rechtsgutes zwar keine Strafe, aber doch eine Ausgleichsverpflichtung als negative Sanktion "angedroht" wird.Es darf nämlich nicht übersehen werden, daß bei allen Fällen dieser Ausgleichshaftung die Androhung zugleich eine natürliche, generalpräventive Schutzfunktion gegen mißbräuchliche und übermäßige Ausübung des geduldeten Eingriff s rechts hat: Wenn nämlich der Eingriffsberechtigte weiß, daß ihn bezüglich des zu erwartenden Schadens eine Ausgleichspflicht treffen wird, dann wird er auch aus eigenem Antrieb zuvor selbst die erforderliche Abwägung vornehmen, ob ihm sein eigenes Interesse wirklich soviel wert ist, daß er dafür einen entsprechenden Ausgleichsanspruch in Kauf nehmen will.
