Arbitration, one of the alternative judicial activities for the state judiciary is closed to the interference of the court due to its nature. However, if it is deemed necessary, interventions can be made for the decisions given in the arbitration within the framework of limited reasons determined beforehand. In today's legal systems, the court's ability to intervene is trying to be limited as much as possible, thus it is aimed to conclude the arbitration that give priority to the will of the parties as intended. Indeed, operating a very strict control mechanism on the basis of the decision means interference with the discretionary power of the arbitral tribunal, which goes against the essence of the arbitral proceedings. On the other hand, deprivation of control of the arbitration decision may also lead to unjustifi ed decisions. For this reason, on the one hand, while the will of the parties is given superiority, on the other hand, there is a need to intervene in the decision, though limited, in order to achieve balance in terms of public order. This requirement is met in some legal systems at the appeal stage and in others within the framework of legal opportunities such as fi ling of annulment or the return of trial. In Turkish Law, interference with arbitral awards is limited to the cases listed in article 439 of the Code of Civil Procedure. However, in practice, in cases that are not stipulated by the Law, the decision of the referee may be required exceptionally. In this case, the problem arises under which legal reason in the Law the cancellation decision can be made. In this study, considering all these issues, the limits of the interference of the court in the arbitral award will be examined within the framework of the reasons for annulment in Turkish Law.
