The cult of beauty emerged in the West with the goddess Aphrodite, and reigns today in social media, driven by the worship of celebrities' images. The "fever" of selfies fuels the desire to change. In 2013, Brazil led the world ranking of plastic surgery, overtaking the United States, according to the International Society of Aesthetic Plastic Surgery report. This excessive practice concerns the organizations responsible for medical practice, such as the Brazilian Federal Council of Medicine and the Brazilian Society of Plastic Surgery. As they have a huge impact on patients' lives, aesthetic surgeries should preferably be carried out by specialized doctors. Patients have the right to have these surgeries and to choose their doctors; nevertheless, their autonomy is not absolute. The professional has the duty to inform the patient about the risks and contraindications of the procedure, and has the right to refuse to perform surgery if it is considered potentially harmful or hazardous to the patient's health. Por terem enorme interferência na vida do paciente, cirurgias com fins estéticos devem ser realizadas, preferencialmente, por médicos especialistas. O paciente tem o direito de fazê-las e de escolher seu médico, mas sua autonomia não é absoluta. O profissional tem o dever de informar sobre riscos e contraindicações do procedimento bem como o direito de recusar as cirurgias que considerar potencialmente lesivas ou arriscadas à saúde do paciente. We aimed to outline the profile of medical professionals in Brazil who have violated the deontological norms set forth in the ethics code of the profession, and whose cases were judged by the higher tribunal for medical ethics between 2010 and 2016. This survey was conducted using a database formed from professional ethics cases extracted from the plenary of the medical ethics tribunal of the Federal Council of Medicine. These were disciplinary ethics cases that were judged at appeal level between 2010 and 2016. Most of these professionals were male (88.5%) and their mean age was 59.9 years (SD=11.62) on the date of judgment of their appeals, ranging from 28 to 95 years. Most of them were based in the southeastern region of Brazil (50.89%). Articles 1 and 18 of the medical ethics code were the rules most frequently violated. The sentence given most often was the cancellation of their professional license (37.6%) and the acts most often sentenced involved malpractice, imprudence, and negligence (18.49%). It is acknowledged that concern for the principles of bioethics was present in the appeal decisions made by the plenary of the medical ethics tribunal of the Federal Council of Medicine.
Objective: To identify the nature of infractions committed by doctors working within the field of psychiatry, between 2010 and 2016, from the scope of appeals within ethical-disciplinary cases judged at the Plenary Tribunal of the Federal Medical Council, based on the medical ethics code, and to list some elements that make it possible to outline the professional profile of those involved.
The assisted reproductive techniques (ART) applied in Brazil, in face of the lack of federal legislation, are based on ethical standards since 1992. The parties involved -doctor and patient -in an artificial conception process count on resolutions of the Conselho Federal de Medicina -CFM (Brazilian Federal Council of Medicine). Recently there were important innovations in the scope regarding who can perform ART and regarding the guiding norms, such as the new CFM Resolution 2,121/2015, as well as Provisions 21/2015-CGJ PE and CNJ 52/2016 concerning the registration of children generated by ART. The latter Provision requires the identification of donors of genetic material. Therefore, the aim of this paper is to present improvements to attend to the best interests of children born through ART and that of their parents, and equality among children when issuing birth certificates in Brazil, regardless of any lawsuit pertaining to a violation of medical confidentiality and the right to donor anonymity, as per the national provision.
