RESUMOO artigo analisa o espaço de Campos dos Goytacazes na perspectiva dos vazios urbanos localizados no perímetro da cidade e a forma como o Plano Diretor do Município administra a ocupação destes espaços para que exerçam a função social que lhes é determinada pelo Estatuto da Cidade. Nesse sentido, foram escolhidos os instrumentos urbanos do parcelamento, utilização e edificação, IPTU progressivo, desapropriação sanção e direito de preempção, apropriados para atribuir ao solo urbano o aproveitamento necessário e suficiente, que permita o planejamento de uma cidade sustentável por meio do entrelaçamento das vertentes econômica, social e ambiental. A posição do Estado na atribuição de uma função social à propriedade privada, em detrimento do individualismo do direito de propriedade é o subsídio para a efetivação do direito à cidade, disciplinado no Estatuto da Cidade. Por outro lado, um Estado subserviente nutre os processos de segregação sócio-espacial, de reprodução das formas de produção e de continuidade de uma sociedade formada por cidadãos sem igualdade de oportunidades. Em Campos dos Goytacazes, a falta de vontade política na aplicação dos instrumentos escolhidos, demonstra a existência de um Estado omisso, em relação à aplicação das normas aos proprietários de vazios urbanos, e desidiosos, em relação à cidadania de sua população, adotando políticas pontuais que não integram os espaços vazios ao contexto social e contribuindo para a manutenção de processos de periferização da população de baixa renda.Palavras chave: Função Social da propriedade. ABSTRACTThe article analyses the space of Campos dos Goytacazes from the perspective of urban void located on the outskirts of the city and the form with which the Municipal Directives administrate the occupation of these spaces for social functions determined by the City Statute. In order to achieve this, the urban instruments of parceling, utilization and building, progressive taxation, imminent domain and land appropriation were chosen in order to maximize the use of urban spaces and to foster the planning of a sustainable city by combining economic, social, and environmental considerations. The position of the federal government with respect to the appropriation of private land, at odds with individual property rights, is an extension of the right to a city stipulated in the City Statute.
