Interrogeant le rôle joué par les juristes – principalement français – dans l’histoire de l’anthropologie à la Renaissance, cet article met en avant la manière dont les juristes humanistes se sont trouvés, par leur travail philologique et historique, au cœur d’une immense œuvre de collecte de savoirs, et à quel point les progrès de la cosmographie et du comparatisme juridique ont permis chez eux le développement de réflexions essentielles au plan anthropologique. Ce faisant, il s’agit de mettre en lumière non seulement l’apport particulier qui est le leur en matière anthropologique, mais aussi de questionner l’inscription du développement de l’anthropologie à la Renaissance dans une épistémè relevant du champ juridique.
L’histoire de la pensée juridique du xvie siècle connaît en France, depuis quelques années, d’importants développements, et même, osons le mot, une véritable renaissance tant, depuis les années 2000, les travaux consacrés par les historiens du droit français à cette période se sont développés. Aussi cet article se penche-t-il sur cette actualité pour faire un bilan des perspectives et enjeux qui peuvent être les siens. Le premier constat qu’il dresse est celui d’un épanouissement des études portant sur les doctrines, via l’analyse des contributions personnelles d’un certain nombre d’auteurs et d’acteurs de la période. Le second porte sur un élargissement de la focale de départ qui permet une prise en considération grandissante des contextes comme de la matérialité des textes, dans le cadre d’approches désormais pluridisciplinaires. L’ensemble concourt ainsi au développement d’une histoire critique de la pensée juridique du xvie siècle français, laquelle permet de resituer le droit dans un espace culturel plus vaste et de le faire sortir de l’isolement dans lequel divers clivages contemporains ont pu le placer.
