This article has both a general theoretical, conceptual, and branch character. It is a complex interdisciplinary study aimed at conceptual approaches establishment to the understanding of national security and the mechanisms for its provision in foreign countries such as the United States and Great Britain. Within the framework of the prepared article, its authors carried out a comparative analysis of strategic legal regulation experience concerning the national security issues of these foreign countries, the use of which is necessary in view of the new global challenges within a national legal system. The specifics of the Anglo-American approach to public administration in the sphere of national security provision are established and systematized.
This article is devoted to the analysis of problems regarding the main approaches to understanding the effectiveness of legal regulation and the search for its criteria. It is known that this issue serves as the basis for ongoing social development, ensuring optimal law-making and law enforcement activities of state bodies, achieving the goals of the procedural and legal regulation, consisting in ensuring, within certain stages of the legal and reasonable consideration and resolution of legal cases, the adoption of appropriate procedural decisions in the interests of subjects of law. The effectiveness of legal regulation is determined by a kind of evaluation category, the essence of which is to determine the level of functionality and effectiveness of this process in its dynamics. As criteria for the effectiveness of procedural and legal regulation are called effectiveness, achievement of the goal, procedural savings and others.
Introduction. This article is a continuation of the publication of the same name in the previous issue of this journal. Methods. The methodological framework of this research is a set of methods of scientific knowledge, among which the main place is occupied by historicist methods of systematic analysis and comparative law. Results. The author distinguishes stages of formation of the concepts of "national security" taking into account the historical experience of Russia and other countries. We present the author's approach to the identification of the factors causing the current maintenance of national security. Conclusions. National security is a multidimensional phenomenon that needs to be considered as a part of the international security with regard to security within the borders of a particular state, including military threats, as well as in relation to the national interests of the certain state's population.
The article deals with some issues of the state power restriction, and the necessity of this is justified. The evolution of state power restriction certain criteria and forms are analyzed in accordance with the emergence of relevant ideas and scientific concepts and their chronology: the restriction of power by another power, self-restraint of state power; the restriction of state power by the law and human rights in connection with the contemporary problems of state power restrictions in a state governed by the rule of law.
This article contains an integrated interdisciplinary approach to the study of legal security and its provision at an international level. The study is aimed at the development of conceptual approaches to the understanding of legal security in a general social sense and the ways of its provision at an international level. The evolution of approaches to the determination of an individual, society and a state legal security is considered, and attention is drawn to the need of legal component strengthening concerning the process of national and international security provision. The main determinants of international activity for legal security provision are established and systematized.
