A linguagem possui um papel central no desenvolvimento das teorias filosóficas que orientam o conhecimento ao longo dos séculos. No presente trabalho, busca-se identificar como a Filosofia da linguagem influenciou a Teoria do Direito, partindo da construção filosófica que orientou à centralidade da linguagem como componente de condição das relações entre sujeito e objeto. Tal mudança, levada a cabo pelo chamado Giro Ontológico linguístico, possibilitou um novo olhar sobre a linguagem jurídica que, a partir da teoria desenvolvida por Herbert L.A. Hart, influenciou um novo paradigma da Teoria do Direito. Por fim, busca-se apreender a relevância do novo paradigma para a Hermenêutica filosófica-jurídica, ao identificar a estrutura prévia da compreensão, na medida em que o uso da linguagem no ato de compreender precede o entender ou a sua representação no mundo dos fatos. Assim, a relação entre linguagem e hermenêutica no direito possibilita suscitar novos paradigmas interpretativos e de aplicação da lei.
