La obra del político polaco Ryszard Legutko Los demonios de la democracia. Tentaciones totalitarias en las sociedades libres está teniendo cierta repercusión en el pensamiento conservador español actual. Sin embargo, el autor del presente texto cree errado el análisis de Legutko; por un lado, por simplista y, por otro, por ignorar la influencia de la técnica en los sistemas políticos occidentales posteriores a la Segunda Guerra Mundial. Este artículo se propone analizar en detalle la obra de Legutko y acotarla. La dictadura es un tabú en los regímenes liberal-positivistas. En ellos, el sustantivo dictadura solo es empleado para designar y denostar al enemigo político. Empero, esta vulgarización del término en nada contribuye al estudio de la dictadura como institución genuinamente jurídica. En este trabajo, analizamos la dictadura desde su dimensión jurídica en relación con un tema de actualidad -el COVID-19- y su posible encaje o no dentro del sistema constitucional de 1978 en situaciones de excepcionalidad. Para ello, se parte de la tipología schmittiana y la diferencia entre dictadura comisaria y dictadura soberana.
Ciento sesenta años han pasado desde que Ferdinand Lassalle pronunciara sus dos famosas conferencias sobre la esencia de la Constitución2. Mas su pensamiento no ha perdido vigencia, sino que, con las décadas, es más y más actual. Motivo por el que la reedición de sus conferencias junto a otros tres textos (el «Apéndice a la segunda conferencia», que recoge dos artículos de prensa, «Poder y derecho. Carta abierta» y «Poder y derecho»), que el profesor Carlos Ruiz Miguel ha llevado a cabo, no puede ser más oportuna.
