Este artigo pretende provocar reflexões sobre as complexas relações estabelecidas entre estado, direito, transfobia e cissexismo no Brasil, atentando para a existência de uma perspectiva transfóbica e cissexista de disputa, mobilização e gestão dos aparatos administrativos, institucionais e normativos do estado e do direito brasileiros que busca marginalizar e exterminar pessoas trans* através de sua invisibilização e da invisibilização de suas reivindicações, da criminalização de suas vidas e vivências, da patologização de suas identidades de gênero e do reconhecimento jurídico-estatal restritivo das suas identidades de gênero.
This article aims to elaborate on the traditional understanding about the will of some workers not to join strike movements, escaping from generalized stigmatizations in order to question whether the act of breaking strikes can be conceived or not, under some specific circumstances and scenarios, as a strategy of resistance that may be used by female workers, besides black, gay, lesbian, bissexual and transsexual workers to face up to sexism, racism and LGBTphobia that exist in the trade union movement, in the world of work and in other dimensions of human life, and, consequently, whether it can be conceived or not as an appeal to rearrange, rearticulate and strengthen the collective action of workers and trade unions, acknowledging the importance of their engagement in the combat against forms of oppression and discrimination that are reproduced in different social dimensions. RESUMO:Este artigo busca complexificar a compreensão tradicional da vontade de algumas trabalhadoras e alguns trabalhadores de não aderirem a movimentos grevistas, escapando às estigmatizações generalizantes para questionar se o ato de furar greve pode ou não ser concebido, em algumas circunstâncias e cenários específicos, como uma estratégia de resistência passível de utilização por trabalhadoras mulheres, além de trabalhadoras e trabalhadores negras, negros, gays, lésbicas, bissexuais, travestis e transexuais, voltada ao enfrentamento do sexismo, do racismo e da LGBTfobia existentes no movimento sindical, no mundo do trabalho e em outras dimensões da vida humana, e se, consequentemente, pode ou não ser compreendido como um apelo à recomposição, à rearticulação e ao fortalecimento da ação coletiva operária e dos sindicatos a partir do reconhecimento da importância de seu engajamento no combate a modalidades de opressão e discriminação reproduzidas em diferentes dimensões sociais.
Partindo de pesquisas empíricas anteriores desenvolvidas pelas autoras deste artigo sobre os processos de precarização das condições de trabalho e vida de trabalhadoras informais e terceirizadas (dos setores de limpeza e teleatendimento), este texto pretende problematizar em que medida as estruturas sociais, econômicas e jurídicas, pautadas em perspectivas classistas, racistas, patriarcais e cisheteronormativas, apresentam-se concretamente como limitantes dos trânsitos possíveis para mulheres cisgênero negras no mundo do trabalho brasileiro (encerrando parte importante delas entre o emprego doméstico, os serviços terceirizados de limpeza e as operações do telemarketing) e para as travestis e as mulheres transexuais (restritas muitas vezes à prostituição e às operações de telemarketing). Escolhemos abordar, especificamente, o fenômeno jurídico da terceirização, sobretudo em suas imbricações com o trabalho de cuidado, para além dos caracteres da reestruturação produtiva capitalista pós-fordista. A terceirização é revista como categoria jurídica fronteiriça e complexa, que se vale de processos de marginalização, invisibilização e desumanização para estabelecer uma regulação do trabalho em perspectiva relacional e mimética aos trabalhos que eram até antes naturalizados em relação a essas sujeitas subalternas no âmbito da informalidade, reforçando e reificando lugares sociais compreendidos como possíveis para elas.
