This paper investigates the certification of insanity through a standardized template called Form K which was used in Ontario between 1873 and 1883. My main thesis is that the introduction of the Form K had profound and long-lasting effects on the determination of insanity. In particular, it created a unique case in the history of certification, it grounded civil confinement on a strategy of consensus, and it informed mental health documentation for more than a century. As the result of a transnational mediation from Victorian England, the Form K prescribed an examination setting which involved a high number of participants, including three physicians and several witnesses. By comparing this case with other jurisdictions of the time, this paper shows how Ontario became a distinctive case worldwide. In order to get a closer look at this medico-legal procedure, I consider the archival records of the Toronto asylum and conclude that the certification of insanity relied on a strategy of consensus. While the Form K proved quite successful in preventing legal actions, it produced financial, logistic, and bureaucratic issues. The Form K was thus discontinued after a decade, yet its structure influenced Ontario’s mental health documentation throughout the twentieth century. This paper shows the relevance of the certification of insanity for transnational history and for understanding contemporary issues of involuntary confinement and stigma in mental health.
This study examines Adolphe Quêtelet's conception of deviance. It investigates how he identified social marginalities and what actions he recommended governments to undertake. To get a close understanding of his views, this paper examines three cases of “monstrosities,” namely mental alienation, drunkenness, and criminality. My main thesis is that Quêtelet provided scientific authority to a conception of deviance as sickness, immorality, and cost thus encouraging legislators to use statistics for containing social marginalities. The case of alienation shows that Quêtelet viewed insanity as a pathology of civilization to be understood through phrenology. The case of drunkenness demonstrates how Quêtelet conflated the notion of statistical mean with moral decency. The case of criminality illustrates Quêtelet's major concern with the cost of criminals for the state. While advocating for the perfectibility of mankind, Quêtelet urged governments to take actions against what he considered the monstrosities of society.
This paper investigates the role of admission forms in the regulation of asylum confinement in the second half of the nineteenth century. Taking the Toronto Lunatic Asylum as a case study it traces the evolution of the forms’ content and structure during the first decades of this institution. Admission forms provide important material for understanding the medico-legal assessment of lunacy in a certain jurisdiction. First, they show how the description of insanity depended on a plurality of actors. Second, doctors were not necessarily required to indicate symptoms of derangement. Third, patients’ relatives played a fundamental role in providing clinical information. From an historiographical perspective, this paper invites scholars to consider the function of standardized documents in shaping the written identity of patients.
