Diante de um movimento das câmaras municipais brasileiras, que atuam legislativamente para limitar ou proibir discussões que envolvam gênero e sexualidade em escolas públicas, o STF julgou a constitucionalidade da Lei nº 1.516/2015 de Nova Gama/GO, que determinava o cerceamento de discussões sobre a “ideologia de gênero” (ADPF 457). Logo, partindo da decisão proferida, o presente artigo se propõe a explicar se é possível demonstrar a inerência entre o direito à educação e uma educação que contemple as problemáticas de gênero e sexualidade. Desta forma, utilizar-se-á do método dialético de Hegel (2005), que permite a contraposição dos referidos institutos, em consonância ao julgado supracitado. Para tal, faz-se uma abordagem qualitativa e uma pesquisa bibliográfica, que auxilia as discussões teóricas, e jurisprudencial (2020), permitindo observar que o ordenamento jurídico brasileiro contempla diversas facetas intrínsecas aos saberes das pedagogias educacionais que tratam a diversidade sexual e de gênero. Deste modo, o objetivo geral é suscitar que estas pautas já estão abarcadas pelo próprio direito constitucional à educação.
