El Alien Tort Statute o Alien Tort Claims Act es un dispositivo normativo incluido en el Código de los Estados Unidos que, tras permanecer prácticamente inutilizado durante dos siglos, ha cobrado reciente relevancia como un mecanismo utilizado para demandar ante cortes estadounidenses a Estados, funcionarios y ex funcionarios gubernamentales, e incluso corporaciones, con motivos que van desde daños materiales, hasta alegadas violaciones a derechos humanos. Dadas sus implicaciones, el alcance del Alien Tort Statute ha sido motivo de constante debate judicial y doctrinario, el cual es motivo del presente estudio.

Con el propósito de facilitar las transacciones comerciales internacionales que día a día se llevan a cabo, la Cámara de Comercio Internacional realiza una revisión y actualización periódica de los Términos de Comercio Internacional (<em>Incoterms</em>), los cuales regulan tres aspectos fundamentales relacionados con la compraventa internacional de mercaderías: la entrega de las mercancías, la transmisión de riesgos entre las partes y los costos a cuenta de cada una de las mismas.
En el presente artículo el autor enfoca su análisis, a la forma en que considera se "pueden y deben" atacar las resoluciones judiciales que deciden un incidente, dentro de un concurso mercantil. Este importante tema lo reflexiona a la luz de la Ley de Concursos Mercantiles (LCM) y justifica sus razonamientos, con base en el principio que ordena, que el juez no puede revocar sus propias determinaciones, y el cual refiere, se ajusta a los principios generales de derecho que tutelan los fundamentos de certeza, economía procesal y lógica jurídica. Concluye con distintas propuestas con las que ilustra y plantea la forma y el medio adecuados de solución de los incidentes concursales, a fin de enfrentar y resolver con urgencia la problemática que en ese tema se presenta, tanto desde el punto de vista práctico, como desde el punto de vista técnico jurídico.PALABRAS CLAVE: los incidentes en la Ley de Concursos Mercantiles, el recurso de revocación, naturaleza de la resolución judicial, incidente concursal.
