A partir de la revisión de dos ámbitos de la relación Estado/pueblos indígenas —esto es, territorialidad y autonomía, proyectos minero energéticosy consulta previa—, se pretende analizar los avances, retrocesos y vaciamientos vividos en esta relación durante el período 1990-2013, con el fin de aportar a la discusión de esta problemática en los demás países que viven circunstancias semejantes enAmérica Latina. Especial importancia tienen para el caso ecuatoriano las constituciones de 1998 y 2008, en las cuales se reconoció el carácter pluricultural y pluriétnico del Estado ecuatoriano en la primera, yel carácter plurinacional e intercultural en la segunda. Asimismo, el movimiento indígena, desde su surgimiento como actor en la política nacional desde 1990, no solo ha sido pionero y referente en la región, sino que ha sido impugnador del proceso de extractivismo llevado adelante por el Estado.
<p>En 1994, con la Ley de Desarrollo Agrario, el Estado ecuatoriano otorgó 127.279,28 ha de tierras para uso colectivo a 37 comunidades afroecuatorianas campesinas en el<br />norte de Esmeraldas. Veinte años después, estas tierras sufren fuertes presiones por la penetración de capitales con fines extractivistas y agroindustriales. Este artículo realiza un examen de la situación de presión sobre dichos territorios y evidencia una pérdida sustancial de los mismos por parte de las comunidades. Esto ha generado graves consecuencias<br />que atentan contra la cultura, la seguridad alimentaria y el equilibrio entre prácticas sustentables de producción y la conservación de la naturaleza. De forma paradójica, la vulneración al derecho al territorio se produce en un contexto en el que el Ecuador cambia su modelo de Estado, pasando de monocultural a multiétnico, con la Constitución de 2008, y a plurinacional e intercultural, con la Constitución del 2008. Estos marcos normativos consagran a los afrodescendientes como pueblo y como titulares de veintiún derechos colectivos.<br />La investigación se llevó a cabo en el norte de la provincia de Esmeraldas, en los cantones San Lorenzo y Eloy Alfaro. En concreto, en las comunas territoriales asociadas a la Federación de Comunas Negras del Alto San Lorenzo (Fecona), que hace parte de la Comarca Afroecuatoriana del Norte de Esmeraldas (Cane). Esta comarca es una red de organizaciones de base étnico-territoriales que defienden los derechos al territorio ancestral afrodescendiente en Ecuador. En el norte de Esmeraldas, precisamente, se desarrolla una importante experiencia de defensa del derecho al territorio ancestral afrodescendiente del Ecuador. Gracias a las luchas de las organizaciones campesinas afroecuatorianas, el Estado ha implementado una serie de derechos para la preservación y el fortalecimiento de su identidad, tradiciones y formas de organización social. Este reconocimiento viabiliza el ejercicio del principio de autodeterminación de los pueblos afroecuatorianos. Pese a estos avances, la realidad de pobreza, violencia, abandono estatal y falta de garantías del derecho al territorio genera un escenario pesimista para que se materialicen los derechos de los pueblos y nacionalidades, y para que se pueda avanzar hacia la construcción del modelo de Estado plurinacional e intercultural y del buen vivir afrodescendiente.</p>
Fernando García conoce a fondo el movimiento indígena de Ecuador. Ha investigado sobre el tema y, al mismo tiempo, ha acompañado a las organizaciones, a sus líderes y a sus lideresas en la participación política y electoral. En este libro plasma su experiencia que junto con sus conocimientos académicos nos ofrecen una lectura crítica, multifacética, sólida y profunda de una parte compleja de la historia reciente del Ecuador. De las distintas teorías usadas para estudiar los movimientos indígenas en América Latina, García recoge aquellas que le permiten interpretar el entramado del movimiento en Ecuador. Su recorrido comienza en los años cuarenta del siglo pasado. Narra la creación de la Confederación de Nacionalidades Indígenas del Ecuador, cuatro décadas después, y de su brazo electoral, el Movimiento de Unidad Plurinacional Pachakutik, en los años noventa. Estas luchas históricas de los pueblos indígenas condujeron a la reforma constitucional de 2008 en la que se de¬ne al Estado como plurinacional e intercultural, y a la formulación de políticas de reconocimiento del sistema de justicia indígena. Concluye con las confrontaciones del movimiento indígena con el gobierno del expresidente Rafael Correa. Una de las virtudes del autor de este libro es su capacidad de sostener la mirada empática, pero a la vez crítica, sobre el movimiento indígena ecuatoriano.
El desarrollo de la presente investigación tuvo como marco de análisis, la realidad socioambiental de los pueblos ancestrales binacionales: Cofán, Pasto, Awá y Afro de frontera, comunidades que a partir del proceso colonialista español y posteriormente con la proclama de la independencia, quedaron fragmentadas con una realidad que azota hasta la actualidad, su pervivencia en el territorio. Este estudio interinstitucional (UNAD - FLACSO), centró su análisis en una profunda investigación de fuentes primarias y secundarias, en las cuales se pone en evidencia una aguda problemática histórica, de explotación de fuerza de trabajo de estas comunidades, como de los recursos naturales que bordean sus territorios. Por ello, es fácil dilucidar las dinámicas extractivas y las consecuencias de estas, a partir del reclutamiento de fuerza de trabajo afro e indígena desde la colonia, hasta la presenta fecha, momento en la cual, dichas comunidades se ven entre el fuego cruzado por la administración de la explotación minera (legal e ilegal), maderera, petrolera y cocalera, que bordean a toda la ZIFEC (Zona de Integración Fronteriza Colombo Ecuatoriana)
