RESUMOO presente artigo analisa a utilização do monitoramento biométrico, por meio das tecnologias vestíveis (wearable technologies), como técnica de coleta de dados para fins de realização de análises de custo-benefício (CBA) no âmbito desportivo. Traçando uma correlação entre o objeto de estudo e a análise econômica do direito (AED), realiza uma pesquisa de cunho jurídico-econômica, com a introdução de uma série de conceitos do âmbito da tecnologia da informação, tendo como objetivo constatar como essas tecnologias são utilizadas no âmbito desportivo, especialmente no contexto das ligas profissionais dos Estados Unidos da América. Valendose do método científico dedutivo e de pesquisas bibliográficas, constatou-se que as tecnologias vestíveis estão mais difundidas do que nunca, não só no âmbito dos esportes profissionais, mas também no âmbito amador, e que sua difusão levanta uma série de questões bioéticas, com repercussões jurídicas diretas, pelo que é necessário que sejam estabelecidas bases mínimas regulatórias para sua utilização, o que vem sendo feito, na América do Norte, por meio de collective bargaining agreements (CBAs), espécies de acordos trabalhistas coletivos entre as associações de atletas e as ligas profissionais.
Using bibliographic, jurisprudential and comparative review methodologies, as well as the scientific deductive method, this work intends to approach the subject of compliance, specially through the corporate, accounting and legal scope, with an emphasis on the reflexes of the Sarbanes-Oxley Act (SOX) upon Brazilian companies. It approaches the concept of compliance, as well as the history of this activity as we know it, analysing the historical context that led to the promulgation of the Sarbanes-Oxley Act, namely, the scandals of Enron Corporation and Arthur Andersen, in the early 2000s. After a thorough analysis of the Sarbanes-Oxley Act main sections, this paper sustains the need of implementing the best practices of corporate governance in publicly-held companies, instigating and ethical culture revolution, aiming to attack in a more comprehensive way corporate wrongdoings and encourage the adoption of the highest standards of compliance, accountability, disclosure and fairness. Finally, it undertakes case studies to report the process of adaptation of two Brazilian companies to SOX regulations, aiming to demonstrate the challenges of the implementation of such compliance programs.
