Os Community Land Trusts (CLTs) são um modelo de gestão coletiva da terra que promove a segurança da posse, assim como o fortalecimento e o desenvolvimento comunitário para populações vulnerabilizadas. Neste artigo, com base na apresentação de experiências consolidadas no Norte e Sul globais, analisam-se os aspectos organizativos e conjunturais que podem contribuir para sua implementação no Brasil. Em seguida, o cenário fundiário brasileiro é descrito, bem como a experiência pioneira em andamento na cidade do Rio de Janeiro. O modelo, ainda incipiente no Sul Global, apresenta potencial para aplicação em assentamentos informais consolidados com vistas a garantir a segurança da posse e o direito à moradia, constantemente negado e violado nesses contextos. Dadas as peculiaridades dos CLTs no Norte e Sul globais, são sugeridas algumas lições que podem ser retiradas dos casos analisados para facilitar a implementação do modelo no Brasil.
Este trabalho busca apresentar uma abordagem propositiva a partir da Lei 13.465/2017, que institui o novo marco nacional da política de regularização fundiária. Para além das vastas críticas à referida lei, já amplamente debatidas no meio acadêmico, procura-se aqui explorar as potencialidades da lei, no sentido de sua apropriação para impulsionar novas formas de relação com a terra e garantir o direito de permanência das comunidades. Para tanto, apresenta-se o Termo Territorial Coletivo, modelo de gestão coletiva da terra bastante disseminado no mundo, mas ainda desconhecido no Brasil. A Lei 13.465/17, apesar de ter um potencial de impulsionar processos de remoção mercadológica através do foco excessivo na titulação individual como paradigma regulatório, acaba facilitando o estabelecimento das condições necessárias para a implementação do modelo TTC nas comunidades urbanas do país. Este movimento pode fortalecer a segurança da posse dos moradores e o controle comunitário sobre o território, que são características intrínsecas ao modelo, e cada vez mais importantes em um cenário de aprofundamento de políticas essencialmente denegatórias de direitos fundiários, especialmente para os mais vulneráveis.
