Introducción: En el Ecuador, la prisión preventiva, genéricamente se trata de una distinción fundada en la gravedad del delito cometido y el tipo de cárcel en el que el sentenciado cumpliría la pena, al ser la prisión preventiva una medida cautelar de carácter personal cuya finalidad es velar por asegurar ciertas garantías procesales; se convierte en imprescindible conceptualizarla. Metodología: Es un estudio de tipo mixto, es cualitativo al analizar las implicaciones sociales de las leyes emitidas, tanto para sancionar como para proteger a los infractores y delincuentes; y es de tipo cuantitativo al utilizar estadísticas de casos previos y las veces que se aplicaron dichos procedimientos, como antecedentes para futuras deliberaciones. La investigación es de tipo documental, al basarse en leyes, reglamentos, sentencias, de tipo descriptivo, de corte longitudinal al analizar el avance y cambio de las leyes de protección de los derechos humanos. Resultados: Un tema que debemos tener en cuenta al momento de hablar de la prisión preventiva es el principio de excepcionalidad; en nuestra Carta Magna en el artículo 77 numeral 1 indica que la privación de la libertad se aplicará excepcionalmente y no como regla. Conclusiones: El sistema penal acusatorio se ha mantenido tan impregnado de las prácticas judiciales del anterior sistema inquisitivo, que aún se manejan evidentes rezagos que se resisten a la adaptación de las leyes actuales, cambios motivados por la inevitable dinámica social; esto da como resultado que se aplique incorrectamente y a modo de una pena anticipada la prisión preventiva.
Introducción: La violencia de tipo sexual puede afectar a todo ser humano sin importar edad, sexo, etnias, condición social o laboral; un punto importante a recalcar es que afecta a la libertad de decisión y de consentimiento expreso del goce de los derechos e integridad sexual de quien se está formando y no tiene la capacidad de decidir sobre actividades sexuales de manera libre. Según el Instituto Nacional de Estadísticas y Censos (2011) el 25,7% de mujeres ecuatorianas han sido víctimas de violencia sexual. Dentro de la exploración física de la víctima es importante detectar lesiones a nivel extragenital, paragenital y/o genital; para ayudar en el proceso se han creado escalas de aplicación durante el examen sexológico forense, una de estas es la Escala de Gravedad de Lesiones Genitales (GISS: Genital Injury Severity Scale) desarrollada por Kelly D. et al. en el año 2013, para valorar y dar una gradación a las lesiones en el área genital de las víctimas femeninas. Objetivo: Aplicar la Escala de Gravedad de Lesiones Genitales (GISS) y relacionarla con la observación directa durante el examen sexológico forense. Metodología: El diseño del estudio fue observacional, transversal y analítico, en mujeres víctimas de presunta agresión sexual que se les realizó el examen sexológico forense. Resultados: Se demostró que existe relación entre la escala de gravedad de lesiones genitales (GISS) y la observación directa (OD) (Índice de Kappa: 0,66; IC95%: 0,52-0,79) para establecer lesiones genitales en mujeres víctimas de presunta agresión sexual. Conclusiones:La Escala de gravedad de lesiones genitales (GISS) no presenta ventajas de identificación de lesiones con respecto a la observación directa.
El estudio explica como las pruebas balísticas permiten identificar el tipo de arma utilizada en el crimen, la distancia a la que se disparó y la trayectoria de la bala. Además, se menciona que las pruebas balísticas también pueden ayudar a identificar al sospechoso del crimen y establecer su posición en el momento del disparo. A continuación, se analizan diversos estudios que han utilizado pruebas balísticas en la investigación de muertes violentas. Se resumen los resultados de estos estudios y se destacan las conclusiones más relevantes en relación con el uso de pruebas balísticas. En general, se concluye que las pruebas balísticas son una herramienta importante para la investigación de muertes violentas, ya que pueden proporcionar información valiosa sobre el crimen y ayudar a resolver casos. Finalmente, el estudio concluye con una discusión sobre las limitaciones de las pruebas balísticas y su uso en la investigación de muertes violentas. Se señala que, si bien las pruebas balísticas pueden ser una herramienta útil, también tienen limitaciones y no deben utilizarse como única evidencia en una investigación. En general, se concluye que las pruebas balísticas deben ser utilizadas en combinación con otras pruebas y evidencias para lograr una investigación completa y precisa.
Introducción: La cocaína es una sustancia con actividad anestésica y psicoactiva que se obtiene a partir de la hoja de la planta de la coca. Desde que se observó la necesidad de identificar este compuesto se han usado diversas técnicas para la determinación y visualización del alcaloide. Objetivo: Identificar la problemática involucrada en la detección de cocaína impregnada en prendas de vestir. Metodología: Se revisó artículos científicos como forma de preselección, luego se procedió a una lectura crítica de los documentos para finalmente analizar el contenido y ordenar la información de acuerdo con su relevancia. Resultados: Se expondrán desventajas importantes en la detección de cocaína en diferentes materiales de prendas de vestir. Conclusión: Los métodos expuestos que permiten detectar la presencia de cocaína en materiales textiles o prendas de vestir presentan diversas desventajas al momento de realizar el análisis “in situ” o en el laboratorio; desventajas como decoloración de los resultados, baja concentración de cocaína en la muestra, espectros o plasmagramas que requieren una interpretación por un profesional altamente calificado, sustancias que enmascaran a la cocaína o la homogeneidad de la cocaína en la prenda de vestir para poder cuantificarla.
