El presente artículo científico, tiene como objetivo general analizar la falta de declaratoria de insolvencia existente en el ordenamiento jurídico ecuatoriano y la posible vulneración de derechos patrimoniales al acreedor. El problema se presenta por cuanto el artículo 416 del Código Orgánico General de Procesos, establece que al momento que el deudor no le da cumplimiento al mandato de ejecución ordenado por el juez, solamente se contempla la presunción de insolvencia, en este sentido no ocurre como en otras legislaciones, que si el deudor no cumple con el mandato de ejecución de forma automática, en primer lugar se declara la insolvencia por parte del tribunal de la causa, y en segundo lugar el acreedor puede ejecutar de forma inmediata los bienes del deudor. Este problema ha causado mucha discusión por cuanto los afectados son del criterio, que no se garantiza su acreencia. La metodología utilizada, estuvo sustentada en el enfoque cualitativo y para ello se utilizó en método analítico comparativo, por cuanto, a los efectos de brindar una solución al problema, se consultaron disposiciones de la legislación colombiana, peruana y chilena, en las cuales si existe una solución precisa en relación al problema planteado en esta investigación. Para finalizar, el presente artículo se efectuó una propuesta de modificación al artículo 416 del COGEP, con el fin que se tutelen los derechos del acreedor y se pueda decretar la insolvencia del deudor al momento de no dar cumplimiento al mandato de ejecución derivado del tribunal competente
En el Ecuador, al año 2008 se constitucionalizó el Derecho a la resistencia, el cual, desde hace varias décadas se considera un tema agotado, o por lo menos, abandonado para la teoría constitucional por considerarlo como un derecho de imposible asimilación dentro de la estructura de los contemporáneos estados de Derecho basados en la primacía de la ley y en los que la sola vigencia de las normas son su parámetro de validez, sin reparar en la justicia o injusticia del resultado obtenido producto de su aplicación. Por lo tanto, el propósito inicial del presente trabajo investigativo es brindar desde la dogmática jurídica, una comprensión clara sobre la naturaleza del Derecho a la resistencia y evidenciar su problemática y posibles alcances dentro de nuestro estado constitucional de derechos y justicia. Un segundo propósito será constatar que la validez, vigencia y eficacia del derecho a la resistencia solo será posible si su contenido se adapta al nuevo paradigma constitucional que abandera el constitucionalismo de derechos, tarea en la que no se podrá desconocer los aportes de nuestra realidad jurídica, política y social.
La normativa vigente en el Ecuador estima al trabajo como un derecho y deber económico-social y garantiza el derecho al trabajo de todas las personas, por lo que regula las relaciones laborales entre trabajadores y empleadores dentro de las diversas modalidades y condiciones de trabajo. El Código Orgánico Integral Penal, reconoce al trabajo como un derecho y garantía de las personas privadas de libertad, permitiendo su desarrollo mediante asociaciones con fines productivos y comerciales, menciona, además, que la finalidad del sistema de rehabilitación social es el desarrollo de las capacidades de las personas privadas de libertad y el ejercicio de sus derechos para su reinserción social y económica. El Código del Trabajo establece que el trabajo es un derecho y un deber social que todas las personas deben cumplir sin embargo no menciona la forma de regulación o la forma en la que se aplicaría la relación laboral cuando se trate de personas privadas de libertad. El Ministerio de Justicia, Derechos Humanos y Cultos como órgano rector en políticas públicas en materia penitenciaria, conjuntamente con el Ministerio de Trabajo, órgano rector en políticas que garantizan igualdad de oportunidades laborales, aprobaron el Acuerdo Interministerial No. MDT-2015, del 22 de mayo de 2015, que pretende regular las actividades de trabajo con personas privadas de libertad.
