Yaşadığımız dönemde bile önemli gündem maddelerinden biri kadına yönelmiş şiddettir. Modern toplumun bireyleri şiddeti yaşamak ve yaşatmak konusunda geçmişin tanıklığından ders almışa benzemiyor. Erkekler, kadınlar ve çocuklar şiddetin kurbanı olsalar da yine en savunmasız olanlar çocuklar ve kadınlar oluyor. Geçmişin tanığı arşiv belgelerinde yüzyıllar öncesinden çekilmiş acıların tazeliği okunmaktadır. Belgelerin satır aralarında, mahkeme sicillerinin genel anlatımı içinde bile şiddeti algılamak mümkündür. Bu çalışmanın amacı, Şer'iyye Sicilleri, Mühimme Defterleri, Şikâyet Defterleri ve Ahkâm Defterleri'ndeki belgelerden hareketle geçmişte kadınların yaşadığı şiddeti bir kez daha ortaya koymak olacaktır. Fakat bunu ortaya koyarken de geçmişte bulunmuş çözüm yollarına da işaret edilecektir. Kadınlar, haklarını korumak, uğradıkları şiddeti ve kötü muameleyi bildirmek, ev içindeki fiziksel, ekonomik şiddeti bildirmek adına mahkemeye başvurmuşlardır. Yerel mahkemelerde çözümlenemeyen sorunlar için bir üst makam Divan-ı hümâyûn'dur. Kadınlar, İstanbul'a (Divân-ı hümâyûn'a) çok uzaklardan gelmiş veya vekil olarak birisini göndermiştir. Bu şekilde çekilen acıların son bulması arzulanmıştır. Çözüm yollarından biri de boşanmadır. Boşanmaya ilişkin veriler içinde "hul'" yani "muhâlaa" ile ilgili olanlar, kadın girişimiyle başlayan boşanma davalarını işaret etmektedir. Kadı Sicilleri'nde kentli kadınlarla ilgili belgeler oldukça fazladır. Köylü kadınların, köylerinden kente hatta başşehre kadar gelmeleri olağanüstü durumlarla sınırlıdır. Durum böyle olduğu halde köylü kadınların uzak diyarlardan, şikâyetlerini sunmak için başşehre kadar geldikleri, belgelerin tanıklığı ile sabittir. Kadınların yaşamış oldukları ezilme ve buna karşı çıkma, direnme tecrübeleri geçmişten ders almanın ve geleceğe yön vermenin yollarından biri olacaktır.
